Cablevision’s founding Dolan family is close to striking a deal to take the company private for at least $10.5 billion, the Wall Street Journal reported Wednesday morning. Hoping to revive plans to pursue a network-based digital-video-recorder system, Cablevision Systems said it plans to appeal a decision last month from a New York federal district court that found that its RS-DVR would violate the copyrights of ABC, Fox and other studios and networks.

“We continue to believe strongly that remote-storage DVR is permissible under current copyright law and offers significant benefits to consumers, including lower costs and faster deployment of this popular technology to our digital-cable customers,” Cablevision chief operating officer Tom Rutledge said in a prepared statement regarding the appeal, which Cablevision said it will file Tuesday at the U.S. Court of Appeals for the Second Circuit...

Cablevision Systems chief operating officer Tom Rutledge said Wednesday that he had not had yet evaluated whether to appeal the ruling last week of a federal judge that is blocking his company from deploying technology that would record television shows inside a cable network at the request of individual subscribers.

Rutledge said he had not yet delved into the ruling and had not had a chance to determine what Cablevision’s next step might be. He added that he had just returned from a vacation in time to speak at the 2007 Bank of America Media, Telecommunications and Entertainment Conference at the New York Palace Hotel here Wednesday morning...

New York sports fans have asked the question all season: What are the Dolans thinking? Now it’s Wall Street’s turn again.

Yesterday the Cablevision Systems Corporation, the country’s third-largest cable operator, reported a loss of $23.9 million last quarter, in part because of higher interest expense and a $30 million settlement with Loral Space and Communications.
