    I have to say. I got a great deal with TELUS. And for it, I agreed to a 3 year contract. But wait, it hasn't been two full months that I have an agreement, TELUS goes and unilaterally changes the TOS.

    This practice has to be stopped at all cost. In Canada it should be illegal to have a contract that can be changed by a single party at their sole discretion.

    Assume this relates to your post about the Cell Phone Contract. Did the TOS state that they could be changed with notice when you signed up?

    "Changes
    These service terms (including any rates and charges) may be changed unilaterally by TELUS from time to time on at least thirty (30) days' notice to you, and such changes shall become effective once you use the service after such thirty (30) day period (which use shall be deemed conclusively to indicate acceptance of such changes)."

    You should post a link to your forum post to give folks more background info and clarify which service you are talking about. Mobility division is different that the residential phone/internet/TV division.

    Granted, I bet TOS are not much different there either.

    Agreed. My service is mobility.

    And the mention in a TOS that the TOS can unilaterally be changed by the grantor of the TOS makes an agreement moot in my opinion and makes it that much more outrageous in the first place. Should simply be unlawful.

    Yeah, but why would you agree to a TOS that you think should be unlawful? I guess we could go around in circles with this...

    That's the problem right there.

    The TOS states it can be changed with notice.
    It's unfortunate you feel taken aback due to the TOS changing 2 months into a 3 yr contract.

    Is the new TOS significantly different than the original one?
    You don't have much of a case as you agreed to the original TOS that stated it could change at anytime.

    As for the changes you stated (arbitration, user generated content, etc...) do they really impact your usage of this service.

    If you feel so vehemently against it you can cancel and perhaps see if the cancellation fees can be waived (don't start cursing at them, be nice) and grab a new setup with another provider.

    How do the other providers' TOS stand up to this one (bear in mind the new federal legislation enacted regarding deep pacted inspection - DPI).

    At this point, you would be better off trying to a group of people to join you in class action suits or protest - posting here will only educate a few people about mobility TOS, and this is mainly an ISP forum. Are there cell phone forums you have posted in?

    A contract can't allow one party to unilaterally amend it, at least not without offering some sort of out for the other party. If you don't like the new TOS, insist you want out of the contract without penalty.
