Now if AT and T wanted to "pay" me for that box in my yard or offer discounted service for the use of my property, I would probably agree. That would a negotiated deal between me and the company to which I had some say in it. Not some thing shoved down my throat. I think thats what the point is. | |

The problem you have with your position is that YOU Joe Schome want to decide what goes in the RIGHT of WAY/EASEMENT. You don't get to make deals on what happens in the RIGHT OF WAY/EASEMENT.

When AT&T can't find a good place in the ROW, they will try to make an agreement with the owner of property near the crossbox. They want a one-time cash deal and will avoid property owners who want to wheel & deal, get free service in perpetuity, and so on. Of course that's easier for them.
They would pay a nominal $1 for the easement, which must be publicly recorded, and might make a separate private cash deal with the property owner, presumably so their costs are concealed. Your going in a different direction than the original post is headed.
Your talking about a new ROW(Easement for the Easement Police) when there is not an existing one or no space in the existing one.
The OP is looking to go "Oh you want to put that in my yard, then I want $20,000 and free service at the highest tier, for life x2." For an EXISTING ROW/Easement.

I won't presume to speak for the OP, but I understood the OP's statement as hypothetical, nothing more. I agree that many people do not understand that a part of their lawn between their house and the street is on the ROW and may be used for other public or common purposes besides just lawn. Right-of-way is not the same as an easement, however. I think somebody already pointed that out. I was referring solely to easement agreements, and not stuff that is put in the ROW.
My point was that in cases where AT&T cannot use existing ROW for VRADs, they make it hard for property owners to figure out what is a reasonable amount to seek for a new utility easement. -- USNG: 16TDN2870 Find your Lat-Long: Geocoder | |

The difference is, FTTH VRADs can be anywhere in the community, since there is no distance limitation with fiber. In areas that use FTTN, VDSL has a distance limitation so there are more VRADs seen in the community.
In FTTH deployments, AT&T could place the VRAD at the entrance of the neighborhood or on a utility lot that holds a power substation or other utility. | |

| VRAD's I have seen where these VRAD's are being setup in NC. In fact, I have seen them being setup around cross boxes in the Asheville area as AT&T prepares to release U-verse there soon. Really, I don't see what the big deal is all about. If there is already one large box there for phone whats the deal in having another one. Its not like its making more of an eyesore. One example I noticed actually had two boxes on the pad and a new pad poured for the VRAD.
Generally, I lean torward "the left" on a great many things. But on this one I think people need to shut up and let technology roll on. Do you want to be stuck with standard DSL or worse dialup for the next 20 years? I didn't think so.
Another factor to consider for the Asheville case is that AT&T can actually provide an alternative to the cable company in the area which is Charter. We all know what charter's reputation is and with AT&T offering some competition both on internet and TV should help things at the cable company or at least provide an alternative. | |

And that one picture (With man posing next to it) looks like some crappy fence and ugly shed colors would lower a property value than knowing you have Hispeed internets in your neighborhood (in..your nay..bur hood!
