Empires will rise and fall....

...and so will torrent sites. If PirateBay goes, some other site in some other country will take over the torch, and before legal proceedings can happen there, we're another 5 years down the road.

I don't think piracy can ever be stopped anymore. As long as it is possible to send data (encrypted or not) from one IP to another, people will find a way, a new technology, etc, to transmit their warez.

I read it has been two years to build the case. Half of it thrown out after two years of preparation? Wow!

Sorry but PB is the gun industry.

and they tried to sue the gun industry for crimes committed and they lost.

PB does not host any pirated files...case closed.

if PB looses then you would have to shut down google, yahoo and microsoft search sites as well.....

Heh!

Too funny! Those ignorant buffoons should be working with The Pirate Bay on a paid distribution method rather than suing them. Good lord the Entertainment Industry is made up of a bunch of clueless people.

Regardless of all of that though, to have to drop half the charges less than 2 days in... WOW. I don't guess they were very prepared.

Legal Defense Fund?

Does TPB have a legal defense fund to which we can contribute?

The latest Dog and Pony Show

Have you seen the latest masthead at The Pirate Bay. Not a very complimentary picture of Tom Cruise, his wife and the "church" of Scientology (COS). Talk about taking on the world. They are on the RIAA hate list, MPAA's whine list, and it would seem on the sh*t list at COS. They track a whole bevy of COS's top secret documents. Documents that COS goons have been charged with breaking and entering peoples houses and offices to retrieve. There you will also find Tom Cruise's rambling disjointed video extolling the virtues of the COS for downloading which the COS have succeeded in getting removed from every site is has appeared on.

You have to admire the Pirate Bay crew's come and get me MoFo attitude they don't do things half way.

Here you go:

said by TorrentFreak :
What has been shown in court today is that the prosecutor cannot prove that the .torrent files he is using as evidence actually used The Pirate Bay’s tracker. Many of the screenshots being used clearly state there is no connection to the tracker. Additionally, prosecutor Håkan Roswall didn’t adequately explain the function of DHT which allows for so called “trackerless” torrents.

The flaw in the evidence was pointed out by Fredrik Neij (TiAMO), who requested to comment on Roswall’s explanation of how BitTorrent actually works. Fredrik said that the prosecution misunderstood the technology, and told the court that the evidence doesn’t show that the Pirate Bay’s trackers are used.

This has resulted in prosecutor Håkan Roswall having to drop all charges relating to “assisting copyright infringement”, so the remaining charges are simply ‘assisting making available’. “Everything related to reproduction will be removed from the claim,” he said.

The defense was happy to see that already half of the charges were dropped during the morning session of the second day. “This is a sensation. It is very rare to win half the target in just one and a half days and it is clear that the prosecutor took strong note of what we said yesterday,” said defense lawyer Per E Samuelson.

Peter Althin, representing Peter Sunde said, “It is clear that this is an advantage for the accused.”

“EPIC WINNING LOL,” Peter himself later commented on Twitter.

IFPI was quick to release a statement where they try to spin the dropped charges into something good. “It’s a largely technical issue that changes nothing in terms of our compensation claims and has no bearing whatsoever on the main case against The Pirate Bay. In fact it simplifies the prosecutor’s case by allowing him to focus on the main issue, which is the making available of copyrighted works,” IFPI’s legal counsel said.

During the remainder of the morning session it was mostly prosecutor Håkan Roswall talking. Among other things he explained in detail how email works (made no mistakes there). Several details on the hardware that was taken during the raid in 2006 were discussed, as well as invoices and email conversations about server costs.

After the lunch break, around 1:30pm the court decided to end the day early. Tomorrow morning the prosecution will continue to build (or break) their case and on Thursday the defense will have its say.

This is a breaking and developing story, check back here for updates….

What is so hilarious about COS is their mythos is almost identical to Gwars. Reading the documents from TPB Xenu was the one who sent The Scum Dogs of The Universe to earth. I wonder if COS has brief in on this case?

50% of Charges Against Pirate Bay Dropped
Written by enigmax on February 17, 2009

There has been high drama on the second day of the Pirate Bay trial. Due to serious shortcomings in the prosecution evidence, around 50% of the charges in the case are going to have to be withdrawn. The defense describes it as a ’sensation’, seeing half of the charges being dropped on the second day.

pirate bayWhat has been shown in court today is that the prosecutor cannot prove that the .torrent files he is using as evidence actually used The Pirate Bay’s tracker. Meh

What I find funny is that we all know without a doubt the PIRATE bay is used for piracy of illegal software they didn't create the website to help spread the goodness of legal torrents. Instead they created the site to help people "steal" other peoples work. But since we're talking all legal stuff "legally" the pirate bay isn't held responsible. Morally however is another story.

Now that being said sure the RIAA and MPAA are being stupid at how they're handling this and should be working to create better methods and stop being so damn greedy so I support the pirate bay. That being said however since I'm going to school to work in the film industry I know how expensive it is to produce films and they need to make their money back. However I also pirate films at the same time so (meh).

Assisting making available

If you look at the Pirate Bay website, they are assisting the download of files by providing a search engine with links. The effects of the 2600 case are still being felt today, where we can put someone in jail for a hypertext link.

Google can also assist you in finding torrents of copyrighted materials, but I notice they are more cautious. They don't support the filetype: option anymore, you can only get links to pages with links.
