AT&T never advertised MMS

Only Apple advertised that MMS would be on the iPhone. AT&T has made no advertisements about the iPhone being MMS capable, except for saying it would be available "Late summer".

The reason it's delayed is due to network integration. I have a friend who works at AT&T corporate in Atlanta and he said it all has to do with routing and the MMS gateways still not being integrated into a single system.

It already works on my non jail broke 3gs wit a lil carrier update. theres no reason ATT hasnt rolled it out I send and recieve video and pics. with no problems at all

BINGO. There is no "network upgrade" or "systems upgrade", some stats guy in the back room said to the guys in suits that if they delay the use of SMS on the iPhone for X days it will create enough hype to generate more sales. Then the suits asked themselves what can they tell customers who want SMS but make it believable.
It's all about numbers; anyone who believes otherwise is a fool. How to maximize profits while keeping cost at a minimum. Of course, I personally wouldn't run a business like that because just look at how "hated" AT&T is right now. I have not heard of many companies go under who treat their customers right, with respect, and listen and adjusted to their feedback.

Or perhaps AT&T just needs a twitter. And if they have one, obviously they don't read it.

I have the picture option on my regular 3G phone but it always shows an exclamation point to the right of the message saying it was not sent.

I agree that we should have MMS, but the basis of this lawsuit is that AT&T and Apple advertised that MMS is available. Show me one AT&T advertisement that says "The iPhone has MMS."

Correct. Once the MMS message leaves the IPhone(or any other phone), it is really considered the same message, travels the same way, through the same systems.

Lame and lamer ...

While a lawsuit over MMS seems a bit lame, it's completely ridiculous that AT&T hasn't enabled this yet. All they have to do is turn the standard MMS feature on. Many figured out that the iPhone MMS works perfectly fine if you just trick AT&T into treating it like a regular cell phone. The trick is short lived because AT&T detects the IMEI and disables it, but how long does AT&T need to toggle a flag? Seriously weak, AT&T.

I suspect that this 'delay' is more due to AT&T beefing up/adding more spectrum (850MHz) and backhaul before allowing MMS.

It's not lame if you think of it from this perspective...

Over the life of a 3G-S iPhone, a customer is expected to pay for the price of the phone plus a monthly service charge. If someone delayed the purchase of that phone until they felt it was "worth the investment" (that worth being justified by what has been advertised and marketed), then this customer is not being provided the expected service.

Breaking the contract would cause an unexpected hardship on the customer because their intent is to spend a defined monthly amount for the service...not extra due to services not being provided by the faulting party.

This is more than simply a customer that wants to send MMS messages. This is about people spending hard earned money and are being possibly disregarded by two corporations though alleged deception.

There is certainly basis for this suit, until the judge finds otherwise.

Just so were clear, was there ever an advertisement that mentioned MMS that didn't also mention "later this summer"? All the ads I can recall made it clear to me that it would be coming later.

Unless there were indeed ads claiming that it would be available at launch, this suit doesn't look to have any teeth.

yeh i took a pic of an alligator by my house the other day with my iphone and emailed to myself ..then took the card out of my moto q ,checked my email and then mms it over to my friend.I know im a dumb cajun but guess what it worked!I did this all from my pirouge in the swamp while running crawfish traps!Pa pa says im a genius .went all the way thru the 5th grade.....

I can't understand why Apple would be named in this suit. Both MMS and Tethering works perfectly here in Canada (with the iPhone 3G). If ATT doesn't support it, that is their call.

When I bought my first gen iPhone and the latest 3G [S], MMS wasn't a top priority, because if it was I would have gotten a phone that had MMS support.

Besides clearly Apple is on the ball as they support MMS in other countries. ATT is holding up the game. Whose to blame for that?

My iPhone 3G could not send/receive MMS or tether...

It's all good now though because I've got the Palm Pre. I'm really enjoying being able to send MMS messages after a year of putting up with Apple/AT&T's shenanigans..

While the overall assessment is basically correct, as applies to this situation, it's not. When someone advertises a feature (presumably to encourage further sales) and a basic timetable for it and demonstrates an existing ability to deliver it to other users/devices, then people have grounds to seek redress. Given that the seeking of redress is not without grounds, it's a bit hard to characterize it in the manner that you have.

Well they should go to the AT&T store I went to. On the iPhone kiosk they had a video "loop" and one of the more prominent loops was of a man inserting a picture of a sailboat into a TXT (MMS) and sending it saying "i think i need a bigger boat!!!" - so that could be considered false advertising.

I don't know what holdup AT&T is having. I think just so they can draw it out another couple months and then say "NEW! You can send PICTURES!" and advertise a "new" feature.

For what it's worth - their billing DOES disable MMS - so they obviously have MMS "control" somehow. The trick to get it working on a 3GS is to swap the SIM to another non iPhone - chose the $20 unlimited txt plan (NOT the iPhone - it has MMS disabled) and then install the IPCC (carrier update) onto the iPhone and it works.

Same with tethering. Oh wait - the world will end if AT&T does not make an extra $20 - 50/mo on the tethering option....

AT&T Sucks A$$

I really hope that as soon as the exclusivity deal ends with AT&T, Apple runs, and runs far and away from AT&T. I'm willing to pay for a CDMA iPhone. Shit... I'll take the iPhone on Sprint. I don't need an iPhone that works in Antarctica or the middle of the Congo... Honestly I refuse to pay roaming fees.

If it has to be class-action... so be it. So sick of the AT&T apology and apathy from the Apple Kool-Aid gang.

Seriously, how anyone can defend AT&T actions is beyond me. I have two friends who work AT&T Level 3 network admins and they all claim its management in the way of all these problems. The technical issues are only "the time it takes to implement once management finally agrees."

I know its not the point but just search in google find the hack and work around it. My Iphone 3g has had mms for MONTHS now and it works great at my end. Most of my friends have had theirs fixed and havent seen any problems.

MMS on Iphone

I asked the kid in an AT&T store a week or so ago, and he told me that the reason that there was no MMS available on the iphone is because when you send the picture, it doesn't compress it as it does on other phones, but re-iterated that it will be turned on by the end of August.

I don't know how true this is, just telling you what I heard. It is ridiculous, my wife's Motorola V557 which has to be pushing 6 years old can get MMS.....but I get this lame text telling me to go to a website and log in with some cryptic password to see my MMS.

I could see this being the case. Almost every network requires pictures to be compressed when they're sent via MMS. Lots of people might get mad when their pictures they sent from their phones look horrible when they send them via MMS to other phones.

If anyone cares to look at the details of there bills, you will notice MMS is being blocked on the account. Just like one would request data to be blocked , or even plain text messages. With a price os 0.00.

So whats up with that?

What is AT&T trying to figure out a way to charge all users now more $$$ for MMS?

If it was to me, find out how much it costs to add MMS on other plans, and then sue AT&T for that times the number of users on iPhones. FOr not allowing thm to do so, but still charing a ton of money for the texting service.

So from my understanding, this new suit will do just great. AT&T deserves it.

The iPhone as a device rocks. It does what it does very well and I'm very pleased with my 3GS.

The issue is not with Apple, but rather AT&T.

AT&T is the weak link in the US for the iPhone.

Im dropping AT&T and no buying another iPhone

I work for AT&T, have an Apple Macbook and an iPhone. I will no longer have AT&T as my cell phone provider, nor be buying another Apple iPhone again. I will go with Android and will have to figure out my next provider. I'm sick of tired of the cahoots of AT&T and Apple. Glad someone is doing something to stick it back to both of them. Im done with them.

B) AT&T has chosen to NOT allow iPhone users to use it right now until they can upgrade the network a little more! It's very bandwidth intensive when you consider how many iPhones are floating around!!!!!

Yea..

And since copy/paste has been available, I've used it once. And that was just to try it out. Funny, I started believing all the hype about its horrible to be missing cut & paste. Almost believing I had to have it. Now that I have it.... I couldnt care less.

Today my brother sent me 4 MMS. I had to use the stupid AT&T website (viewmymessage.com) and it wouldn't work. Kept saying there was an error or something of the other.

Palm Pre hate

I don't understand why iphone users hate the pre. It's a nice phone that mutifuntions its butt off. Sprint is good in my area (Chicagoland) as a matter of fact I have a friend that is going through some of the same buyers remorse I'm reading here. He says things like "I thought I was buying the best so why doesn't my phone do that?". I didn't know you couldn't get pictures via texting on an iphone and he was getting pissed because I kept asking him if he got the pictures I sent Lol. He also can't stand that he has to close an app to start another one while I just let things run in the background (GPS, email etc.) while I send a text or whatever. I'm not saying the pre is better because I just bought a new battery so I don't have to keep charging it throughout the day. I use my phone A LOT. I'm addicted to facebook mafia wars, and I listen to Pandora so it eats up the battery. Come to think of it he was kinda bitching about that too so he'll probably get the extended battery for the iphone. Anyway as far as Sprint goes, I think as far as bang for buck I'm doing ok. 4 phones with unlimited data, mms text, gps with traffic and 1500-1800min (not sure because we never go over) shared for 165. Oh yea one has direct connect. As far as the false advertisement...Why not go after them? If you knew some of these things ahead of time would you have still bought it? Tethering is huge for many people. Just thought I'd chime in for some reason G'night
