Isn't porn made to be shared ?

Did Hugh Heffner sue dads who didn't prevent their sons from consulting their collection of Playboys ?

Did Hugh Heffner sue teenagers who exchanged the playboys they found in the dad's collection ?

In fairness, the porn industry can't pay their crews if they don't get paid by people who watch the material. Remember, it isn't just the bare naked lady who gets paid, it is also the people who record the moaning and groaning, the sound editors who sometimes succeed in synchronising the moaning and groaning with the girl's mouth/lung movements.

Perhaps the porn producers should buy outfits such as xtube and show their movies for free and collect the advertising revenues.

Or perhaps porn should go all amateur. No more artificial moaning and groaning to dub over the director's instructions to the porn stars.

They brought a lawsuit against some for file-sharing in Florida and the judge there threw it out.

Blackmail

Blackmail doesn't work with me.... Assuming for a moment that I downloaded a porn movie for me & my "significant other" to watch and they people suddenly tried to file a law suite & threaten to make it all public before court & demand I settle....

I'd make it public before them...

The upload their video (and collective works) on so many sites, irc channels, usenets, and p2p network / sites.... My 1 download would be the lest of their worries.

What's worse?

The fact that the Porn Industry is profiting off of those who are pirating the material. Who does this benefit in the end?

I know, I know, they stole content. But still, a bit sick don't you agree? I mean, really, just take a minute and think about all of those who watch porn (I do not watch porn, don't condone it, but that is a personal choice for those who do) and want to in privacy. Like I said above, I don't condone it but the fact that the Porn Industry is trying to profit off of this really makes me sick to my stomach.

Empty threat?

With the vast amounts of free, legal porn of every stripe online I really don't get this.

You can literally go *anywhere* online and get anything you want freely, legally and within full compliance of every IP statute imaginable. They literally stream hours of this stuff everywhere...

What's the industry trying to accomplish?

It's not a coincidence when she is a porn star named "Sasha Grey" on Entourage and she is an actual porn star named "Sasha Grey."

I thought it would have been pretty apparent from the show, especially when they mention the movie "The Girlfriend Experience" which is not a porn, which she is also in.

Product placement....

The porn industry needs to learn about product placement.

Sex toys, rings, mail order stores etc could all be paying nice sums of money to have their products "featured" in a porn movie, at whicgh point, the producers would encourage as many free downloads as they could since this would increase the amount they can charge to advertisers.

Heck, even doctors could pay to have their names featured:

guy to girl: "I really love what Dr Boobs from Los angeles did to your breasts, they look so much better".

And if this becomes more popular, even beer/booze companies could get product placements ads in porn movies.

Doubtful. People that like porn like NEW NEW NEW. Just a few guys are not going to make enough new porn. And they aren't going to do it for free. Where are you going to get girls that will do porn for free?

Not worth the risk?

When it comes to private sexual fantasies and fetishes, going public is probably not worth the risk that these torrent and peer-to-peer users are taking
Oh no, they are going to reveal that most of the pirated content is male-female straight sex, "lesbian" sex (or some variation of guy(s) with multiple women), or just some woman getting off by herself. If the general public didn't already know this, they need to check their reality batteries again.

I got "caught" once when some friends noticed a video title on my HTPC. They feigned being surprised and like all good friends, tried to thoroughly embarrass me about it. I didn't care. It wasn't like it was midget gay horse bondage porn. And even if it was, an overwhelming majority of people have looked at porn on the internet anyways. Let he who hasn't sinned cast the first stone.

This may cause suicides

BBC reports that a 19yo new york guy committed suicide after a video of him having sex with a male friend was published on the internet by his roommate. The roomate and another person are to be charged with invasion of privacy.

I think the porn industry may have to review its "shame" policy because if their deeds ever causes someone to kill themseves, they would be liable for some heavy duty lawsuit if not criminal charges.

It's totally different. The case in the news involves someone having legal, consenting, sex, with "a reasonable expectation of privacy", being filmed in the act.

Your leap-of-logic would make it illegal to file charges against anyone for anything. E.g. RIAA and MPAA couldn't file charges either. Heck, banks couldn't file charges against bank robbers.

Just don't be stupid enough to explicitly point out in writing, or verbally, that the mere filing of a charge would destroy the defendant's career. Simply get a lawyer to write up boilerplate letters... "we have evidence that you infringed on our IP. We request that you compensate us with a payment of $X, and to cease and desist such IP infringements immediately. If you do not comply, we reserve the the right to seek redress via the legal system".

There is quite a difference between Film company X filing charges against an individual, accusing him of copyright infringement for one of their productions,

and Film company X taking out ads on the net/newspapers revealing that an invididual has illegally watched < embarassing film title >

That crosses the "stupid" line I mentioned in my post. It's one thing to issue a press release saying that you have filed charges. If you issue a press release saying that Mr. X HAS done something, you run into a couple of serious problems...

•Item 1) You can win 99 out of a 100 cases, and get several thousand dollars from each defendant. But the 100th defendant, who is found not guilty will be able to sue for every last single penny the plaintiffs have. Given the situation, the only people who will stand up and face the publicity are those who truly are innocent, and want to destroy you. This self-selection means that anybody who does stand up to the suits will have a better-than-average chance of being found innocent,

•Item 2) If you publicize the case, the defendant can claim that he can't get a fair jury trial because of the publicity that YOU have done. Courts do not take kindly to "obstruction of justice". This, again, increases the chances of a defendant being found innocent.
