Interesting part of the Comcast letter

I thought this part of the Comcast letter was interesting:

If you believe in good faith that the allegedly infringing works have been removed or blocked by mistake or misidentification, then you may send a counter notification to Comcast. Upon Comcast's receipt of a counter notification that satisfies the requirements of the DMCA, Comcast will provide a copy of the counter notification to the party who sent the original notification of claimed infringement.

How does the user prove that they have removed the offending file(s)? How do they prove that a mistake was made in identifying the files? What exactly "satisfies the requirements of the DMCA"?

I don't know if you get KROQ down in Oceanside, but i think you do.

On their Kevin and Bean morning show, they had a few people who received threatening letters similar to that comcast letter. (I recently received one last week).

They had spokesmen from the RIAA/MPAA and a few listeners on the air, and they specifically said what to do.

I e-mailed the hosts Kevin & Bean, and i got a response from one of the other DJs who said that they'd put me on the air on monday morning, to discuss my case. Sort of a warning to other users, so that universal doesn't burn their balls.

RE: proof of compliance. From what i've seen in other posts on this forum, and PMs from other users. All they did was send a brief letter (1 paragraph or so) saying that downloading the file was a mistake, when they realized that they had it they deleted it, and barring all other assumptions that Comcast forwarded it to MPAA and all was happy. (Although, i'd suppose you're on some sort of watch list with your ISP)

24 Hours to delete!

I have been on the web since back in the days when AOL was the redheaded stepchild to Prodigy and Compuserve. I remember the gool ol' 'warez' days when BBS were still the reigning choice, (before the raids). Now it's p2p's turn in the chair with the spotlight shined in it's face while the RIAA cops try to beat out a confession or two... My point is what comes around goes around, you will never stop trading, nor should you, as I and several other 'millions' can atest to, trading HELPS the music industry with a 'try before you buy' theme. Kill p2p and IRC will rule again, kill IRC and BBS will come back into play, or something new will pop up. Until prices of music and software is respectable, the people will find a way. We demand it. No sense beating a dead horse, you all know this already but one thing I have YET to read anywhere is a MAJOR point that use to be displayed on every warez page on the web. And that is, as law states ( I am not a lawyer so I am not sure what law) but you have 24 HOURS to delete any software you downloaded before it is illegal to own. This is more then enough time to download a game or app and try it out to see if its worth spending your hard earned money on, (since it's ALL overpriced to begin with). As far as I am concerned, I can download ANYTHING legally as long as it is deleted from my system within 24 hours. Now, did the DMCA do away with this once popular law or what????

Rovolving IPs by Scripting Ethermacs?

Anyone think of using a revolving IP scheme? Most broadband providers assign your IP via DHCP. As far as cable modems go, simply changing your ethermac address for your NIC will instruct DHCP to give you a new public IP. Granted this is an "after the fact" method but it might prove too much of a hassle for ISPs to look for the old IP by digging through the logs. NTM by the time the ISPs get the xxAA's letters that IP could quite possibly not be leased anymore. Not practical for manually recoding your ethermac every 24 hours but I can't imagine coding such an app to do this automatically would be too difficult. Running behind a router would of course defeat this approach but most routers also have the ability to manually code the ethermac address. Most broadband provisions only allow 1 public IP assignment and to enforce this they only allow one ethermac. Resetting the cable or DSL modem might also be required to forget the other ethermac and route cache however not impossible to script this function as well. This is a low tech but potentially effective method. Any thoughts?

Piracy is not real

You know I just dont get it. This world is all about money. Thats very sad I think. Thanks to Ceaser for his great invention. But on the other hand I think music and programs that help people should be free or not as highly priced. Money does help, but it is not worth everything. And thats what these companies are moaning about. Just get over it and be free.

Court: Nothing to Fear!

The copyright laws in question simply have no application if you are outside the United States. I know, you are probably thinking you are inside the United States, so here is a cite your shyster lawyer will never explain to you when you get sued:

USC 17 Sec. 101 (2)
The "United States", when used in a geographical sense, comprises the several States, the District of Columbia and the Commonwealth of Puerto Rico, and the organized territories under the jurisdiction of the United States Government.


… and before you presume that you are located in one of the several “States”, here is the definition of “State” from the same section of US code:

"State" includes the District of Columbia and the Commonwealth of Puerto Rico, and any territories to which this title is made applicable by an Act of Congress.

Well, I for one am not in the “United States”, so how are you going to make this "code" apply to me? The legislation passed by Congress have no bearing on me, any more than they would to the man on the moon.

I myself do not share or recommend that others share the copyrighted property of another, but I though I would offer up this little fact for those interested. I know this is a hot topic, and wanted to share my 2cents.
