Terrorism...bah to that! Protect me from "pirates"

Ok so our government has successfully shredded the constitution to pieces with the patriot act, invaded a country under false pretenses, and arrested 2,000+ muslims without access to lawyers/family. Does anyone else find this completely moronic? Protect me from terrorists and criminals, not from some stupid little kids downloading mp3s that they DON'T HAVE THE MONEY TO BUY ANYWAYS! Somebody explain to me how it's stealing if A) You're not going to buy the product anyways and B) They are not losing anything. Nothing is PHYSICALLY being taken from the companies. They aren't losing anything. oh well maybe when a football stadium full of 40,000 people gets blown up our idiotic, moronic, stupid, embarrassing, and aarogant government will figure something out for once.

I think it's GREAT that the scumbag Pirates are gonna do jail time in addition to fines from $10,000 on up AND the RIAA gets to sue them after the DOJ hangs the Pirates azzes!! Now that, THAT is enforcement of law!!! This should send a clear message that the sleazebags stealing copyright protected material are gonna pay and that the legislative and judicial branches of government agree with the RIAA on theft of copyright protected materials.

I dunno if it's just me, but when a third of the COUNTRY is doing something, it should be legal. After all, we ARE THE PEOPLE, and isn't it supposed to be the PEOPLES voice that gets represented?

You know, we have the power to change laws... and I've never seen a law that couldn't be changed when a third of the FREE country goes against it. If it doesn't, then this ISN'T a FREE country, and the PEOPLES voice doesn't mean squat any longer!

If you guys are serious, we need a day of partition... a day when all song-swappers alike send our lawmakers, businesses, and government a message... that our voice is LOUD!

I know I may get attacked by some idiot (the minority... in this case) who says that file trading is just WRONG. Well, that may be true... to a point; however, I don't ever seen any of them stand up against the acts that these businesses, politicians, & lawmakers do EVERYDAY to the PEOPLE of this country! It's almost as if it's an accepted norm to get crapped on...

Sorry, if you want to continue down the path to a world like this... be my guest. But, there's other nations you can migrate to, to do it in!

I say go ahead and let them make this a crime. But at the same time the RIAA and MPAA has to give up the 130 year copyright. I still don't understand why patents are only 17 years, but copyrights have to be 130? Twenty years sounds about right.

Storing things that you own on your hard drive is not illegal what is illegal is distributing them without the coywriters consent. And thats what file sharing is.

Common sense. When you place a copywrited file in a shared folder you're assuming that someone will probably want to download it and there for when someone downloads it you are distributing it. It's really not that much different then passing out pirated copies of movies or music on the street. Common sense is something that Many Canadians lack. Their Judges will come around eventually on this issue just as they finally did with satellite hacking.

With that being said I wish the US would rule the same way I run emule practically 24/7 but I still know it's legally and morally wrong and I recognize the RIAA and Congress' right to enforce the law. The US will probably never rule in favor of file sharing because we are a more common sense type of nation.

Its not morally wrong to share music cause your not making money of the music. Ask your dad if he ever made copies of tapes and thought twice. What because this is a digital copy its somehow bad now? If 1/3 of your population is doing something how dare you call it illegal when your supposed to represent the people?

I find it wrong to pirate software just because the fact that someone took time to make it to make money off it. I don't find it wrong to pirate music. Why? Because it's all about the music. Artists say that they create music for the people and because they like to and yet complain when their record sales aren't meeting expectations so they jack up the price. Bad move. Now you have less people wanting to buy music and more people willing to download it for free. If this process was reversed, there probably would be a decrease in piracy and more record sales. This is not for certain though since there are already piracy p2p software out there. Now this could inflict more people to pirate songs since they are cheaper but since they are cheaper, more likely people would have already bought the cd with the songs and wishing to download those song they already purchased is not illegal. Thus, making p2p software useless for downloading music.

Summary:

1) Costly music, more piracy of music.
2) Decent priced music, less piracy of music.
3) Try to kill p2p software will only create more programs and more people to rebel against outrageous prices.

Hmm,

I think we need a clarification here. When they say 'wire-tap' do they mean in the traditional method, voice-only? Or do they put a tap on ALL your digital bits and watch everything your doing un-encrypted ( and encrypted if they can do simple attacks) and watch you, say ssh-ing/ftp-ing a MP3/DIVX file to a friends server? If so, this is downright SCARY.

If its the former, its disturbing, but not so bad.

But if the latter: what will be the probable cause that will trigger the warrant/tap? Jay walking? Posting negatively about the Media industry in a forum? .. uh ** deletes *.mp3 **

Anyone know?

Remember the FBI's Carnivore (how come we never hear about Carnivore anymore??) has been up and running for a couple of years now, at all the major ISP's; just a quick flip of the switch, and anyone, with this Bill, can be targeted and watched.

So the government should just give up and legalize all drugs? Or just let people use and sell drugs all the want? Tell that to all the parents that lost a child to extasy and other such highly dangerous drugs.

Drugs are going to always be around. But its distribution should and is being limited. Same should go for piracy. It's only common sense. A trait many here obviously lack.

They would still need a court order with probable cause as with anything to tap in. Probably what they would be doing is picking up packets of information as you're downloading. The question is where are they going to get this probably cause and your IP address.. Are they going to have their own little internet P2P police force breaking the law by downloading copywrited files from us? Or are they going to rely on vigilantes like the RIAA to do this for them.... It all sounds kind of silly to me.

To purchase any product from a member of an organisation who oppose the rights granted us under the bill of rights is immoral.
Purchasing any entertainment from any member of the RIAA or MPAA is vile, as it attacks not our mean pleasures of cheating them, which are themselves immoral, but attacks the basic law of the land.

Best way to solve it is don't buy it

Everyone gets so excited about when something like this gets in the news and I don't know why. The easiest way to solve it is to not listen to any RIAA product. The RIAA won't be able to sue cause there won't be anybody left that will listen to there Cd's. The musicians will scream cause no one is listening to there music. Only buy music from musicians who actually care about there music fans and not worried about million dollar contracts. Then maybe the musicians who are under the RIAA umbrella will get together, get there act together and say it doesn't pay to be with the RIAA.

Let me get this straight...

The DOJ would wiretap suspects and then file a "civil" suit? So the RIAA can sue again in a slam dunk based on DOJ evidence gathered at taxpayer expense?

It's not the DOJ's place to do the RIAA's dirty work...nor do I see any logic or precedent allowing the DOJ to sue for damages. Criminal suit...sure. But WTF do they need a civil trial for?

F**k this, I'm moving to the Netherlands....

What could the RIAA be thinking?

If the RIAA really is serious about getting its sales back up by reviving an old type of doing business, here's a suggestion for them. Since I was taught this in high school business courses, apparently no one at the RIAA has completed high school. Hopefully this will help you, anyone from the RIAA reading this.

Alright here it is, the big secret...
-If your business is based upon satisfying your customers' wishes, and working with them rather than against them, you will find that your sales increase dramatically. Work against your customers (i.e., sue large numbers of them), and suddenly you will find that they no longer wish to deal with you anymore.
-The major entertainment companies have been against innovation since day one. Such companies have attempted to prevent the development of the VCR, the cassette tape, and even, yes, the RADIO, by suing. In each case, once the industry dropped (or more frequently, lost) their lawsuit and began working WITH the new technology rather than against it, they found it to be a tremendous benefit. (The artists' "association" when radio was formed cried that radio would be "the death of music", and the movie industry moaned that the VCR meant "no money to create new movies." We see how true that's been don't we? They make MASSIVE amounts of money off of each technology. Had they WON any lawsuits against these technologies they would have been far poorer or even bankrupt today. Filesharing could be a massive benefit to such industries, bringing the next point...)
-Voluntary collective licensing could ensure that creators of software, movies, and music get paid, while consumers still have access to such at a reasonable FLAT rate. For more information, visit »www.eff.org.

Just my thoughts on the issue, hope some of you from the RIAA or supporters thereof are taking notes. It really ain't rocket science kids.

Italian situation (jail for p2p but....)

I'm italian, here in italy because of an official american request the government approved a law that can put file-sharers in jail up to 3 years (only who both download and upload at the same time); they're going to modify the law and the iter for the fix is already discussed and going to be approved in the next week so everything is going back before August.
After the fixes there will be minor sanction like one of 154 Eur the first time and 1040 Eur + equipments for the second time.
Thy're discussing about a way to legalize p2p or at least have p2p users to pay a standard small monthly sanction through their provider for what they're downloading like is made in Brasil.
Also here there is something like a not really visible fight between american producers and italian producers.
