No Reciprocal Injunction?

Something tells me that same judge didn't also put an injunction on WhenU.com until "all the legal details of the case are sorted out."

Oligarchy

Thomas Jefferson predicted "the despotism of an oligarchy" if judges are allowed to be "the ultimate arbiters of all constitutional questions." Can anyone really disagree? After all, isn't the elected legislature supposed to be the body making all of the rules? Aside from the fact that a bunch of nutjobs are trying to kill us, I see this as the biggest problem in America today.

What's good for the goose...

Does that judge who granted WhenU an injunction against
Utah's anti spyware law own a computer? Chances are good
that he or the court he presides over does. Watch those
computers get infected by WhenU or other spyware, and see
just how quickly he rescinds his injunction. If he has
children at home, or less clueful co-workers, there's a
very good possibility that this has already happened.

Stuck in catch up mode

Judges and politicians alike are stuck in catch up mode. For example the DMCA, politicians signed off on it and now we are seeing some politicians saying they didn't even know what they were signing.

As in the case with the Utah spam law, the judge don't understand what is truly going on. He is only going by the testimony of some backwoods company.
