That's a pretty funny response. I have to wonder though, is it really legal to host copyrighted movies in Sweden, as they say in the response? I can't imagine that it's legal, so it looks like "The Pirate Bay" is setting themselves up for some real legal trouble by responding and getting the lawyers' attention.

In spite of the efforts of the RIAA/MPAA, "piracy" is not legal term, it's just something they adopted to make it sound sinister.

"Contributory infringment" or "infringement by inducement" is more like it. And yea, since Sweden is a signatory to the Berne Convention and recognizes copyrights, I wouldn't be surprised if it violated some Swedish law, who knows. They don't have to worry about the DMCA, but the "morons" remark may not have been the wisest thing to do, lest it encourage you-know-who to hire a swedish legal firm and look into making trouble for these guys. Kinda smacks of immaturity, if you ask me. And I bet that particular choice of lagnuage was not chosen with the approval of their lawyers.

According to swedish laws, a electronic billboard can't be held liable for the contents that is published on it. So Bittorrent trackers are legal, but the people seeding the files are less legal.

Sweden has some pretty tough laws.
It's just that they are virtually unenforceable.

IIRC You basically have to admit to hosting/downloading the file in order to be charged. The police can hold you for questioning for a reasonable time but short of admitting your guilt that's all they can do.
This was a couple of years ago. I don't know if things changed. I have some very good friends who are Swedes.

If france succeeds in forcing ebay to remove all nazi relate stuff from their auctions because of their laws, then this is going to end up going both ways. Sweden will have to shut them down just because people in the US can access their site. I don't know about you, but I don't want other countries laws affecting people in america, and american laws affecting other countries. Eventually a stupid little country is going to pass some crazy law and will want the world to follow it.

That is not correct it would be for eBay France only, not the rest of their sites around the world. French law is not enforcible outside French territory. That was the point of the response letter. This why China filters the Internet in their country.

France is not respecting our laws. Plain and simple it would be a a violation of our rights. However if yahoo france is hosted in france and the company is registered in france there suseptible to french law. The way to go about this is to not let any french people have nazi material. This article is actually very disturbing because i think that we should have the nazi materials floating around to remind us of the horrrors we faced. France Really didn't force e-bay to change it was ruled that material was illegal in France and if e-bay didn't remove the material that France would block all French nationals access to e-bay as a whole it was entirely ebays choice wether or not to remove the content

Government subsidized fiber to the premises. They really are a well governed country. Be prepared for their extreme northern location (dark winters) before you relocate. Also, the language is hard to learn.

It would be better if one of the many law firms representing the RIAA/MPAA would send some of these nasty lawyer grams to someone in Russia, and then that someone would be connected to the Russian mafia and pretty pissed off. I wonder why the MPAA has not targeted Russia/Eastern Europe with their DMCA notices yet.

I am seriously considering that myself. Canada is a good alternative to Europe. It's a peaceful country, your pretty safe from lawsuits for downloading, speak English and are right across the border.

It's the Internet, people. You don't have to move, you just need access to a computer in Sweden/Canada/wherever. (Hint, rent web-space somewhere.) You do your DCMA-questionable downloading there. Once you get it to the foreign-soil server, you ship it to the US, inside an encrypted pipe.
