Teenager getting off easy if facts are correct

If the facts of the case as reported by AP are correct and the teenager was selling the downloaded stolen material than I think he got off pretty easy. But it is a nice warning for others that this isn't just about copyright infringement, but about theft of service.

But this not like file swapping...

Here is what makes it different:

Investigators claim he had "$50 million in music and movies" on his PC, and was selling the content to others.

He was SELLING the content. Not just downloading and swapping.

Lock them all up ...

And then see what kind of impact it has on society, the economy, etc. Hopefully they can come up with sufficient jail space for the large prison population that would probably double or more in size.

In fact, I am curious to know how many kids of politicians and judges are commiting illegal activity because they think its trivial.

No, the wrong move was selling it.

I do not think those going after people care if you were reselling the stuff or not. They want convictions, because it makes them appear to their stockholders as they are doing something.

I'm waiting for the imprisonment of a 12-year old to catch wind--for publicity sake.

Yeah when I read this early this AM I was wondering how it would get reactions.

They actually let him off easy. Selling stuff like that is wrong, and no amount of justification makes it right.

$50 million worth of music and movies?

How much do they think each CD/DVD is worth?
Wouldn't you need several hundred terabytes of downlaoded/rippped CDs and DVDs for your collection to be worth that much?

He deserved alot worse sentence. I got no beef with people that wanna download anything off the internet but when ur doing it to turn a profit cause ur too lazy to get a job then you deserve to be put in our over-crowded prisons with bubba.

Profiting

He was actually profiting from the acquired content. I didn't read the article, but he could just download it or go to blockbuster, rent it, rip it, burn few copies and sell it.
In NYC, every other corner is offering pirated material.
I think those people are true enemies of **AA. First people buy pirated media for very cheap, and not overpay for genuine product. That way **AA is loosing lots of money.
Filesharing is different. It's not about money but fair-use.

Based on the sentence, the judge didn't feel the material was worth anything at all, or he would have ordered restitution. (which goes to the victim, not to be confused with a FINE which goes to the county)

I agree that he deserves to be punished, and that he got off easy with what they gave him. There is a big difference in just downloading a song and selling it for profit.

I'm just questioning that claim of $50 million worth of stuff. That's an insanly large amount of data.

No I think he did not order restitution because they were giving this kid a HUGE break.

They could have sent him to Federal Court and maxed it out, but that = bad publicity.

This sets the warning example while giving someone a chance to correct their ways.

Didn't read the article. CTR-F for selling.

Re: $50 million worth of music and movies?

Let's assume $20 DVD and $15 per CD. Let's further assume that each (compressed) DVD is 1,000 MBs and each CD is 100 MBs. Finally, we'll assume 15 songs per CD and he had equal dollar values of DVDs and CDs.

Do some quick math...

For the CDs: 1.67 million cds, 25 million songs, taking up 166,666,667 megabytes, or 166 terabytes.

For the DVDs: 1.25 million DVDs, 1,250 terabytes.

For a grand total of 2.92 million volumes, 1.25 million DVDs and 1,416 terabytes.

Um, either my math is wrong or this is physically impossible, due to:

1) Not that many CDs have been widely released
2) Not that many DVDs have been widely released
3) I don't think many people have a 1,500 terabyte hard drive.

I think the judge used a different formula than I did (or made up the number).
