What they cannot take away is your "reasonable expectation of privacy". If in the actual use of the app, you expect that your conversation is private, but in fact it is not, they have violated your rights and may even be in direct conflict with federal wire tap laws.

To me, and I am sure the rest of you feel the same way, a two party chat is basically the same as a phone call. You do not expect that someone will be listening in to the conversation. And they shouldn't be without a warrant. This is the same to me. Their TOS is meaningless. It's meaningless because it's well known that nobody ever reads it so their expectation of privacy is still reasonable. The only good solution would be to be blatant about it, such as putting a banner across the top of the client informing the user of the lack of privacy. Anybody up for a lawsuit????

there's something called Encryption

if you encrypt all of your aim conversations you have absolutly nothing to worry about (i know that both parties have to have encryption, get all your friends to get keys or Make there own).

Why not use ICQ?

I do and I love it. I have been using ICQ almost from it's inception and I can't think of ever using anything else.

Not only that, but it has a chat that is superior to anything else on the Internet. It is interactive, you can see what the person is typing in real time and it supports multiple users.

What more could you want in a chat?? Makes sense to ME
