Same as Geneva....but different

Basically holding Lafayette to the same rules that Geneva IL is trying to uphold with AT&T.

How does this happen....

...when a single corporation, driven by green, can sue a town, of voters/elected members who democratically VOTED on a plan to improve their city.

If corporations can successfully squash government/citizen voted actions out in the open through the court systems, we are in trouble.

Clearly the town wants next gen. type fibre, BellSouth should get on the wagon and offer up some type of agreement to help or anything, instead of doing nothing but trying to suck the town dry. God forbid they have significant competition.

The difference is...

...if Lafayette runs the project, it will be city-wide wall-to-wall carpet.

The typical telco only wants to toss out a couple of throw-rugs for the wealthy.

Because the state in which that town resides in passed a law in 2004 alleging to protect private telecommunications businesses from unfair government competition — called the Local Government Fair Competition Act .

Perhaps the local government should shoulder some of the blame for passing such a law. Does it make it right for cable & telco's to be able to sue? Who knows, its in the eye of the beholder.

instead of doing that, why doesn't Bell South spend its resources (intead of putting lawyers to work, God knows we have enough of them already), to actually building the infrastructure to compete with that? Remote DSLAM's. etc. to extend the range of their service areas??? INQUIRING MINDS WANT TO KNOW--

why can businesses sue these cities? Wouldnt the company want the city to lay the groundwork so it is cheaper for the teleco?

Mostly because these cities politicans have been bought by the telcos and cable companies, passing "Anti Competition" legislation.

Imagine for just a moment if these clowns would have spent a fraction of the money they've wasted trying to oppose muni broadband options, and invested it in their networks?

sounds like there should be a good for the community clause or technology advancement clause that would help the community . Like emminant domain for internet lines. If the teleco is not going to fix the blight the city will(blight as being slow copw lines)

I thought Utah's project Utopia acted as you are describing, which means the municipality installs the facilties and provides wholesale access to anyone and everyone for resale of services.

law was passed by STATE after very serious politicing by BS. problem at this point is question of whether the LUS parent utility company can shoulder financial responsbility to improve bond rate. LUS lawyers and BS lawyers agree to disagree.

telco's just need to dump this dinosaur known as DSL. look at all this unlit fibre that was laid decades ago.
