| 3500 is not reduced price The RIAA represented that they were going to give a discount of $1000 to those who settle this way. But $3500 is not $1000 less, it's at most $250 less. In the pre-named defendant phase of the case they settle for $3750 or $4250.

| Extortion Wikipedia states:
Extortion is a criminal offense, which occurs when a person either obtains money, property or services from another through coercion or intimidation or threatens one with physical harm unless they are paid money or property. Refraining from doing harm is sometimes euphemistically called protection. Extortion is commonly practiced by organized crime groups. The actual obtainment of money or property is not required to commit the offense. Making a threat of violence or a lawsuit which refers to a requirement of a payment of money or property to halt future violence or lawsuit is sufficient to commit the offense. The simple four words "pay up or else" are sufficient to constitute the crime of extortion. An extortionate threat made to another in jest is still extortion.
In the United States, extortion may also be committed as a federal crime across a computer system, phone, by mail or in using any instrument of "interstate commerce". Extortion requires that the individual sent the message "willingly" and "knowingly" as elements of the crime. The message only has to be sent (but does not have to reach the intended recipient) to commit the crime of extortion.

| Re: Extortion The RIAA gives the copyright CRIMINALS a choice. They can settle their case and avoid attorney fees and possibly a higher damage amount, or they can take their chances on either a jury trial or a bench trial. No where does the RIAA say, "pay up or else." They are not threatening these people with a lawsuit, the lawsuit has already been files. You can only settle your case on their website if you already have your case number. You can't settle a claim without already having been sued. THIS IS NOT EXTORTION BY ANY STRETCH OF FEEBLE MINDS. -- Fight the war against secular progressives before the ideals that made this country great are lost forever | |

| The RIAA's "pay up or else we'll [continue to] sue you" method is extortion by Wikipedia's definition.

| called...... they can't talk to me.....hung up I have never downloaded a song. I have had a few sent to me however....3...maybe 4 Anyway, I just wanted to tell them whats on my mind. I won't pay a buck for a 25-30 yr old song....but I would pay 25 cents and not bother to "back it up".
So.... Morgan asked for my name....I said I just have a message. She said...well, I can't talk to you...and hung up.
Its really too bad these folks are so stuck in their ways they won't get their heads out of their azz. One has to assume sales for this older stuff is fairly stale. So why not try 25 cents..... -- Thermaltake 2000a/Asus P4C-e/p4 3.4/ocz3500 2x512/WD.2x200g/raptor2x74 raid 0/ATI 9600/APC sua 1500/Logitech z-680/ Samsung 213t LCD/MX 1000

As an example of what's wrong with the music industry these days, the National Association of Recording Merchandisers came up with their "Definitive 200" all time greatest albums list.
A quote from the above sums up the Marquee Blogger's sentiment on this:
quote: But both as a "definitive" list and as a ranking of the top 200, the Rock Hall's selections are about as dopey as the Grammys' yearly irritation-fest. Santana's "Supernatural" at No. 13? Shania Twain at No. 21? 1976's "Sparkle" as Aretha Franklin's one entry? "Blonde on Blonde," Elvis Costello, the Kinks and the Velvet Underground nowhere to be found?

| This only affects Major label music You know there is a lot of hype about the fiasco that is raising the rates internet radio broadcasters are paying to play big label music. People are going so far to say that internet radio will disappear completely because hobbyists (such as myself), small stations, etc won't be able to pay the fees.
One thing that seems to be overlooked is the vast wealth of quality music available on the net by independent and unsigned artists. These artists for the most part will allow pod casters, internet radio DJ's, etc to play there stuff for free, in return we give props to the artists and provide links back to the artists websites where the listeners can purchase the CD's (for much, much less then the big labels charge).
So what the hell does this all mean? Well I personally think that it could end up being a wake up call for the RIAA and others. If all the small stations, hobbyists, etc band together and stop playing major label music in our shows and find content that is equally as good from independent artists (and most could use the added exposure as well), itll send the message to the controlling bodies that a) we dont like their method of business and wont stand for it, b) we do have other OPTIONS other than being forced to play by their rules.
Not only that, but the bands that need and really deserve the promotion/exposure end up getting it. I mean do you think Metallica or Hinder really need anyone to promote their music??
This could be a huge benefit to the independent bands and the stations that promote them
Thats just my $0.02

| Re: This only affects Major label music You're nuts. The world doesn't revolve around obscure whack jobs playing a ukelele in some coffee shop or a bunch of tree hugging activists who think that if we just love our enemy they'll like us back.
What you call bad music may be what others enjoy and that doesn't make them dumber than you. You're an elitist. Who the fuck are you to tell people what they like is inferior to "good music". People like styles of music for their own reasons and don't need judgement from assholes like you telling them "your music sucks, mine is cool". What're you some fucking little child who needs to feel superior to everyone? Not everyone was locked in a closet like you nor is everyone emotionally damaged enough to listen to "independent music". It's independent, it's cool but it's not viable for a broadcaster to make a living from because that market is so fragmented. We're talking about building a business that employs people, feeds their families etc and your way is the starving marvin method and if that's your thing... cool DO IT. Don't tell us "who needs popular music" because you think the world should be as miserable as you. The only thing that will happen is the power will switch to the few companies left standing after all the 1club.fm, 1.fm's choiceradio.com's of the world disappear and people will then listen to the big boys who reap all the profits from having the pendulum of power swing in their direction because they'll be the only choices featuring a VIABLE amount of people to create awareness for their "artists". There's nothing wrong with popular music, there's nothing wrong with oldies, classic country and countless other formats THAT DO NOT EXIST ON TERRESTRIAL RADIO.
To think we're all going to just form some irrelevant music site and make a living from it is stupid. You just go ahead and play all that and draw miniscule amounts of people to your site while the rest of us who know better (knowing that it takes that and a ton more of channels the MASSES actually enjoy) to make your site relevant enough to make a living from AS A BROADCASTER.

1 edit | Re: This only affects Major label music To Ju Ju Bee: Wow somebody doesn't like other people to have opinions!! I don't see anywhere where I said one type of music was bad or good, What I did say was that should the rates keep increasing and smaller broadcasters can't pay the fees, well theres always the option of promoting Independent artists...
Maybe re read what was written.

| Internet Radio: Geat Analysis If you want a good analysis of what's happening (aside from most of you who don't know what you're talking about) or off on some tangent about right vs. wrong or some other crazy thing about "independent music" or raping your a woman etc - it's that A.D.D. crap that lets shit like this happen - you get off track and forget what the fuck the fight is all about) read this. It's the real world and a way that may hold some water in this fight against "organized crime". | |
