Kids, this is never going to go to trial. This is nothing more than a grandstanding ploy by Viacom to force Google's hand. Neither side wants this to go to trial, and both sides want to settle the issue. They throw around the big numbers like manhole covers so that the dolts working for the wire services will have something to sink their teeth into. (As you know, wire service dolts LOOOOOOVVVE numbers, even if they don't have a effing clue what they mean, exactly.)

Yeah, it's bullshit, but this is Corporate Big Money America, what the hell do you want. You want to sit around the campfire and sing kumbaya, go back to sixth grade.

Still boggles my mind.

Why aren't these copyright holders just mimicking the way youTube works and setting up their own fan sites where fans can edit and alter shows/movies and post videos? If it works like youTube it probably will have no problems succeeding. It's only because they don't offer something similar to youTube that their fans go to youTube.

Google has as a lot of money and they are not stupid, if they though they would lose they would have gotten some kind of agreement with them before this lawsuit got filed.

Having a lot of money doesn't always win for you though.
Just ask George Steinbrenner. Can they fight it? Sure they can fight it. But what is it they're fighting? I think anyone who's honest about it KNOWS that you tube is primarily engaged in the business of distributing copyrighted material and if they didn't have that..we probably wouldn't even know they existed.

And so, that begs the question, why would a legitimate company who's doing so well intentionally throw themselves into that snake pit...and pay a lot to even do it.

It's somewhat like someone deciding to download copyrighted songs off the net, using their real name, address and phone #..and having a note attached to it saying..c'mon RIAA, sue me. I have a lot of money to fight you.

It really seems as if, despite all costs, they were just bound and determined to own the hot company known as you tube...despite what business they were engaged in.

That could come back to haunt them big time down the road I think.

Don't get me wrong. I hope you tube is around forever. It's awesome. But, I think any honest discussion about them has to acknowledge that a great deal of what they offer up is video that they have no right to distribute.
Google needs to be careful that someday, some sympathetic jury doesn't decide that the violations were so huge and so blatant that maybe Viacom should get to own a big chunk of google as repayment.

It's just crazy to me that successful google would have stepped into this snake pit.

This is never going to trial. This is nothing more than a high-profile gambit by Viacom to assert the upper hand in any settlement. Neither side has anything to gain by a trial. It's no different than when Don King sued ESPN for $43 billion because of some perceived slight.

What goes around comes around, they say. I wonder who'd be screaming if Google/Youtube said "Sure, we'll pull the copyrighted material you claim, and additionally the viral marketing crap like publicity videos and trailers that you and your associates have uploaded for publicity purposes".

After all, Viacom and other media producers get free publicity and promotion by using Youtube's systems and bandwidth for their publicity videos. Let Viacom pay Youtube for hosting their stuff.

Of course Google must follow the law, I think they are complying with the DMCA though. There is a steady removal of copyright infringing material, also a steady re-posting of it. The key is how well does Google respond to Viacom's requests, and what the law requires them to do.

Of course I can see why Viacom thinks the law is on their side, since they helped pay for it to be passed.

I work for Viacom and this is just a case of a failing mega company hoping to cash in on some other more successful business model. If Viacom had modernized its business plan YEARS ago... this would be a non issue.

My opinion is kinda OT but none the less it is equally or more important that the large majority of you guys easily recognize right from wrong (and /or keep the biased opinions to a minimum).
If this was even possible on one of the socialist Euro(pee)on nations, most of the mindless population would side with Youtube.
Or even worse scream YouTube "no se cierra" (in allusion to southern Spain Delphi closing).
On topic, I hope Google put this calculated risk on the books before they acquired YouTube.If not they should pay the piper, move on and learn from their mistakes.

I think we should all live in a vacuum. Good Lord forbid we should hear or see something we didn't pay for. I guess when I walk down to the mailbox, get my mail, and hear some annoying crap on somebody's noise pollution bass pounding car stereo, they'll have to come sue me for hearing music I didn't own. You can say my analogy is valid or flawed. Doesn't matter to me. The silly nature of it all validates this statement.
