Comments on news posted 2007-05-17 09:26:25: Lafayette, Louisiana, locals have won their right, via a state Supreme Court ruling (and vote), to wire their city with fiber after a long legal battle against BellSouth, Cox and other area opponents. ..

hmmmmm.....

Isn't this an instant that the "FCC" should have "intervened" on behalf or the city? If the voters approved the project, than they understand the "risks" involved. I think Lafayette should go after the "citizens" behind the lawsuits for damages and lawyer fees and other court costs, seeing how they lost at the supreme court level. This might make the "citizens" think about their actions in the future...JMT

and people wonder

why the ILECs are perceived in such a poor light!
BS is dying and their only hope (desperation) is tying this up in the legal system. The last gasp of an obsolete technology dinosaur.

It ain't over till the fat lady sings ....

... or in other words the fiber system is built. LUS saying no one can challenge them in court ever again is ludicrous. The La Supreme Court ok'd the bond but with the proviso that the funding follows the approved law. If bond funding doesn't follow that law, then back to court they go.

actually they can't return to LA Supreme Court on this issue. the incumbents had 14 days to appeal the decision and chose not to. as far as the Court is concerned, the bond matter is closed. they can return to District Court and pursue a different issue exclusive of the bonding mechanism and it's interpretation. their other choice would be to pursue the matter up the ladder in Federal Court. in that case, the anonymity of Ms Naquin will end. at some point she will have to appear at which point the public may have an insight as to who is involved. As AT&T has assumed BellSouth, I doubt the folks in Bedminister will pursue this. my opinion.

Legal fees covered by a corporation on the behalf of a citizen should be taxable. That would clean-up the whole mess. Send in the IRS, they'll figure it out.. and they have tanks!

What grounds exist for the FCC to get involved here? This is a fight in state court over state law, without federal involvement.
