Apple and a popular Web site that published company secrets about the maker of the Mac computer, the iPhone, and the iPod have reached a settlement that calls for the site to shut down.

Apple and the site, »ThinkSecret.com, settled the suit, which Apple filed in January 2005, and no sources were revealed, Apple and ThinkSecret said in statements.

College student Nick Ciarelli, ThinkSecret's publisher, said he plans to move on. He started the site at the age of 13.
Apple is more Microsoft-like now than even Microsoft is. Apple goes out of its way to suppress and crush its critics.

I never visited the site, nor do I know anything about ThinkSecret's creator, but if he's not an Apple employee, how can his site be shut down like that if the his information is considered "hearsay"? I guess obviously he was right a lot of the time, and the idea is that he had help from people inside Apple?

What am I missing here? I know I don't have the full picture.

I think that the legal hook they base a lawsuit on is that the sued person encouraged an insider who has signed a non-disclosure agreement to release confidential info. Or the sued person signed a non-disclosure agreement at some private company presentation and then released the info.

The poster child for the much-discussed "ad supported" business model, SpiralFrog finally went live after a lengthy delay that saw its original CEO leave the company and millions of dollars in music-licensing fees wasted while the service hovered in limbo. It works much like any other music subscription service, complete with iPod-excluding DRM technology, only it requires that users view ads at least once per month rather than ask them to pay a monthly fee. All major labels and many independents are onboard.

Belying its name, Slacker actually worked overtime this year, with two service launches. The first, in the spring, marked the start of its free, ad-supported customizable online-radio service. It then followed up in November with phase 2: transferring that service to a portable device that uses Wi-Fi to update channels, and a subscription service tier that offers users more functionality for a monthly fee.

Start with a service that lets users stream free music, then hope to gain as many users as possible, so that when the labels threaten to sue, you can turn it around into a licensing deal instead. That's what Imeem did. After Warner Music Group initiated legal action against the playlist streaming service, Imeem implemented filtering technology and an advertising system from Snocap to cut Warner in every time a user played one of its songs. It now counts all four major labels as partners.
Looks like Apple and their iTunes empire are finally starting to draw some viable competitors. Amazon.com has the money and size to give Apple the hardest fight.

Not Me I did all My shopping at Collins Street Bakery online which will deliver the best Fruitcake ever made from Corsicana Texas(Nothing like made in the USA in this case), Four Presidents think so too and So did My late Aunt and Brother too. It's being delivered by UPS on December 24th. These Fruitcakes are delicious and even a bit crumbly too, Not hard as a rock like other brands and they are protected by a Metal tin which has a stiff box around that for shipping worldwide.

Today I made up 3 photo CDs on My PC and I now have to put them each in their own box and wrap them, Then in the Bag they all go, Then I'll be done.

I haven't, and probably won't even bother. I've ended up with extra hours from people taking off for Christmas who have attempted to guilt trip me into the whole "I didn't find out until I made my plane reservations"

Ahwell at least the people who I will eventually send a January present to, won't be giving me the eye when I visit later on in 08. :S

Linking to infringing songs illegal in China

It is being reported by the IPFI that Yahoo China's music search feature violates the law when it deep links users to pirated music. Yahoo China's music search has been confirmed illegal in a Beijing court ruling which states that under new copyright laws it facilitates mass copyright infringement.

After being hounded by the IFPI since April 2006, Yahoo! China - partly owned by one the world's most prominent internet businesses, Yahoo! - today had its music search (via deep linking) deemed illegal by a Beijing Court, who said the service violates Chinese law by facilitating mass copyright infringement.

Yahoo! China had appealed against the guilty verdict reached in the case in April, but this was today dismissed by the Court.
This decision wipes out the "search defense" that many companies try and use, where linking is supposedly not infringing.

Traffic

Wow, the Traffic tonite is the worst I've ever seen. Crazy stop and go for miles, every street jammed, oh, and people colliding all over the damn place. Highways crawling along bumper to bumper. It took nearly 2 hours to get home from work, and it's only 15 miles or so.

Wow... Never ever seen it this bad.

I noticed that too in my measly 6-mile commute. I think a lot of corporations are having their holiday party's tonight too, as a ton of steakhouses and fancy places I passed had valet lines out the ass.

Same here, had the unfortunate experience of driving the family car today. Ended up at the gas station where drivers insisted on honking their horns at people in their way who didn't pay at the pump. While I was cleaning the salt off the windows with a squeegee and my father was inside paying, I had this woman who obsessively honked her horn and purposely boxed me in even though I had nowheres to go until the bill was paid inside ::rollseyes::

Only happy person I saw was the woman giving free samples of Bailey's Irish Creme just before closing. She had her fair share of free samples and was more than willing to oblige to those asking for refills on their shots

Wow that's rude. They say the #1 way to cause a "Road Rage" type incident is to honk your horn at someone.

I think if I was at the pump and someone started blaring their horn at me, I'd decide to go into "Turn up the radio and do some maintenance" mode. IE, let's wash the windows, let's carefully check the washer fluid, oil, transmission fluid, etc... Or if it was too cold I guess I could always climb back inside and balance my checkbook or something useful.

Course this is assuming I have time. If I don't, I could just flip them off.

I don't believe that's going to happen. I don't think Google is going to acquire a whole media outlet. My opinion.

Another thing I disagree with. I don't think MOST of the hardware. I don't think by and large any PC hardware is going to be bought from Google and used, but I do think most of the services we use will be geared more toward Google. Hell, tonight I just changed the email services from my host to Google Apps.

Disagree. Do they need to? No. Will they, no idea. 10x30 second commercials for the Superbowl will be chump-change for them.

This is I see as relatively possible.

Agree. Seems like a natural line of progression.

Don't think so. And if they do, they'll fail. My opinion.

Back in the day, I thought Google's logical step would be to acquire Mozilla and Firefox. Didn't happen. People thought it would. Even if they do create an operating system, who are they going to market that to? Most people who buy a computer don't even understand if they want Vista or XP. And I don't think you won't find an Apple user switching from Apple's OS to Google's.

Anyway, my opinions are are as useful as those predictions. Both mean essentially nothing until something actually happens.

Merry Christmas eveyone. Let's hope 2008 is a better year for everyone, even if 2007 treated ya well.

More patent nonsense from Amazon & Google

The patent claims cover blurbs generated using a blurb authoring pipeline ('internal blurbs') as well as those obtained from external sources via RSS feeds ('external blurbs')." The details show that the patent is for personalizing these "blurbs," but it's difficult to see what's patentable here.

Google has patented "snippets"? Now wouldn't that make for an interesting patent infringement lawsuit? Google's patent appears to be about taking a document and coming up with an automated summary "snippet" that can be displayed with search results. Again, it seems like a stretch that this should be patentable, but the patent office clearly feels differently. So, let's see... if both blurbs and snippets are patented, what's next? Clips? Who wants to patent clips? Yahoo? Microsoft? eBay? Anyone?

As they become big dogs, the news folks will dig up anything and make it look evil. Google however, is still the trendy savior of the universe so for the moment they are untouchable.

Also note how there's not that much bad "evil" press towards Microsoft lately? Perhaps people are finally realizing that any company can turn to the dark-side of business practices if they sugar coat it enough.

My damn ViXS TV Tuner still doesn't work. Numerous calls to Gateway and Microsoft, I'm thinking about returning the computer. I'm giving it one last shot, maybe Gateway will send me a replacement TV Tuner and maybe it will work. I'm also thinking of calling ViXS themselves--maybe it was a faulty batch?

Cisco loses heir to throne; will manage by committee

A "development council" composed of several executives will replace Cisco Systems Inc. CEO heir-apparent Charles Giancarlo, who has resigned. Cisco Chairman and Chief Executive John Chambers announced the appointment of the group of executives to oversee acquisitions and other business deals on Thursday after he confirmed Giancarlo, his chief development officer, was leaving.

Chambers said in a conference call he and Giancarlo held with reporters that Cisco is shifting from a "command and control" organization to a network of task forces and other teams. Such a structure is rare in the tech industry, where heroic and charismatic executives often cultivate loyal followings. But "management by committee" approaches have become more common in the legal and financial industries in the last decade.

Chambers said he has little intention of stepping down in the near future; he emphasized that he would remain CEO for at least three years, more likely five. Meanwhile, Giancarlo alluded to his ambitions to be at the helm of a company, and he was frank about the shrewd calculations he made about his career after turning 50 this year.
Cisco has dominated in enterprises and in internet backbone networks. Changing to management by committee is a safe way of managing, but it doesn't usually lead to a company that exploits innovation. So this is a strange choice in the technology field.

Circuit City losing money 3Q

Saw Circuit City lost amazing amounts of money in 3Q, imagine how motivated the staff is when you lay off ALL the upper paid employees and ask them to reapply at lower wages, then give the executives $600K-$1M bonuses to stay.
The guys on the sales floor is where retail profit is made, not those execs.
Rewarding them when results are bad is stupid.

So many companies make the exact same mistake. Mine included.

To make more profit, they cut costs (Ie cut labor) at the base level.

Guess what. For awhile, it works.... you have less expense, and coast on your history. Profits go up.

However.... what you are cutting really is customer service. Support standards, customer service standards, all suffer. Long term, you just are cutting your own throat.

Management seems to forget that 100 PERCENT of all the profit comes from where the rubber meets the road. IE from where their employees directly interact with the customer. EVERYTHING ELSE IS OVERHEAD. (That includes their management pay and bonuses.)

So, when you eliminate employees and transfer that workload to remaining employees, you are basically FORCING your employees to divide their work efforts among a lot more customers... basically, attention to the customer, and good service takes a dive. Plus, you overwork your employees, and stress them out, and lower morale. Think that motivates them to try harder to please the customer? NO.

What happens is the mentality shifts from "Let's take the time to please this customer" to "Man I really don't have time to deal with this crap, I have too much work to do!" ... IE your employees would rather get rid of your customers so they can complete their tasklists, stupid checksheets, DAW assignments, and other "performance" workload requirements without getting in trouble! (IE unable to finish, overtime, missed deadline etc.) It's NOT the employees who are at fault. It's BAD MANAGEMENT.

Cut employees, pay, benefits, and cut customer service. It's not complicated. Short term gain, long term pain.

And as the downhill slide begins, what do they do? Blame the employees of course and start "Cracking down" by toughening up standards, linking pay to "performance" (IE punishing employees for problems by cutting pay and bonuses due to worsening customer service/complaints etc) and taking a hard line on overtime, tardiness, absenteeism, etc etc

Chronic short-staffing is a recipe for failure. It may take years, but it's a slow death. Problem is management never sees it as short-staffing. They call it "efficiency" or some buzzword labels like "Ideal labor capitalization" or "Labor performance to expense ratio".

FairTax Calculator

For all of those out there tired of the lame tax system we have here in the US, check out the FairTax.

They've launched a new income calculator and you have to love the numbers. However, I will say they don't ask how much you spend, but given you get so much more back, you can now choose to spend more, less or if you have the proper *cartman voice-over* discipline SAVE it and then spend the interest you make . This of course assumes FairTax gets put into place, which with the grassroots support growing everyday can happen, if you take action as well.
