Dish has the money that's been decided/awarded from the earlier court case sitting in a fund specifically for the time when they finally "lose". They even mention it in their annual report filing.

Essentially, Tivo believes that anybody who makes something even remotely resembling a DVR is infringing on them. They will not be going after Motorola or Cisco. Those two companies will be using Tivo software for the DVRs so there is no reason for Tivo to go after them. They may go after DirecTV once their agreement comes to an end. |

Besides, I asked how Dish losing market share and these issues are related (turns out the story here was just a lot of re-wording of the Multichannel News article anyway). If a customer's DVR did get shut off, they're obviously already a Dish customer, and therefore not part of the "lost" market share. |

They've dumped, or are dumping, their 3rd-party set-top software for DVRs and are writing it themselves. Basically, if your DVR can record a show while you watch another show 'live', you're infringing on TiVo's patent(s) and are in violation. If you don't pay the licensing fee, they're going to sue you. |

I really like that with the Dish DVRs I only need 1 coax as opposed to the 2 I had with DTV at our previous residence, but if they lose and the DVRs are shut down we are gone, live TV sucks. |

And did people leave ? For the record, and you can get this from their annual report, Dish had just over 13 million customers in 2006 and for 2007, they had a little under 14 million. So, they gained customers... |

It's not the fights with Tivo, or with Directv for market share or any other BS that's killing DN.
It's FTA. If you don't know what it is, Google it.
DN's security system is completely hacked and with the right equipment and software you can get all their programming for free.
Over 2 million FTA receivers have been sold in the USA and Canada in the last five years. Enough said. |

The difference here is that TiVo has licensing agreements with many other companies (Cisco, Motorola, Sony, Panasonic, Comcast, Cox, DirectTV). So they won't sue them. They sued Dish, because while TiVo and Dish were in good faith negotiations, Dish copied TiVo's designs and came out with their own TiVo. |

Actually they don't think they own the concept of time shifting. They own the TimeWarp patent, which is a specific type of time shifting designed to work on devices with very little processing power (this is the Media Switch).
