Aside from the issue of the Court requesting all this info to hand over to Viacom, another issue should be why Google needs to KEEP all this info. They are a greater threat to privacy than the judge in this case and in Viacom who merely wants the data to get Google to fork over money for hosting their movies, TV Shows, etc.
Google makes a lot of money off of copyright infringement. Viacom wants Google to hand over some of those profits. And this is a way of determining how many people are watching their content and not paying for it. -- My BLOG .. .. Internet News .. .. My Web Page |

Why do I get the feeling nothing good will come of this either for the users or Google?
And yes, why does Google keep these detailed records in the first place? Yea I know their goal is to index all the world's knowledge, but is this really necessary to achieve this mission? -- The difference between genius and stupidity is that genius has its limits. |

I think Viacom has a pretty compelling reason for the records.
The need for court proceedings is almost laughable. Once asked, the judge should have just granted the billion. If Google doesn't feel the need to moderate their own site of copyright infringement then they should pay the piper. |

I'm as concerned about privacy rights as anyone. But if you want to blame someone for their erosion then it's those who commit piracy and child porn on a grand scale. No one wants to prosecute porn, but child porn is another matter altogether. And piracy on a small scale wouldn't grab anyone's attention. But those who commit these crimes on the grand scale of megabyte, after gigabyte, after terabyte... they're the ones you need to blame.
You certainly can't blame the man for trying to stop it. And a site like Google or MySpace that lets all this crap happen, and keeps track of it to boot- Well you can't blame the man for making them cough it up. I'm not saying that MySpace condones or contains child porn. I'm AM saying though that SOMEONE is making it possible to transmit it across the net and around the world- a lot of someones. And that's where my point of view jumps from the Googles and MySpaces to the WWW.
It has always been said that if you build a better mouse trap the world will beat a path to your door. That is so true. Well the man has largely taken a hands off approach to the web until lately. But the greedy and the depraved have built the perfect storm, and the man is coming to the rescue. This is going to be as big a mess as that idiotic ruling that just came out of the Supreme Court about the Gitmo detainees. -- You're an American. You get a free pass, but nobody rides for free. |

Are you really implying that someone who uploads, say, a 30 second clip of the intro of a TV show with the theme song should be sued for it? Or a 2-3 minute scene from that same show? Or a series of clips put together in the form of a music video? Should someone who's really just looking for, literally, a specific quote, or wants to see the intro to a show they used to watch 20 years ago, have to go out and pay $30-50 for a full season of the series just to find that one thing? Would you? I wouldn't. Maybe I'm just cheap, but for instance, when I wanted to show my daughter the intro to the old Disney cartoon Gummi Bears, I wasn't about to head out to Best Buy and get a full three-season set to do so. Now, if I wanted to show her the episodes, I'd gladly fork over the money. But just to show the intro? NO.
Maybe I'm utterly naive, but I've yet to see anyone hosting full episodes or movies on Youtube. The most I've ever found are clips. Hell, I've used it before to look for things when I wanted to show them to people. Do you actually think people go...well hey, I'd like to watch every episode of X-Files...ever...I know...I'll look on Youtube! Yeah right. Give me a break. Are they going to start going after people who make screen caps and fansites and AIM icons again? Fanfiction? What's next? -- You're watching Sports Night on CSC so stick around... |

Google does moderate Youtube, deleting thousands of video each day, and has also implemented automated detection of copyrighted content. But even then, you should read the 'Safe Harbour' provision in the DMCA.
As for... oh i'll just shut up, I'm just falling for obvious flamebait. |

I dunno if anyone else found this part, but I read that Viacom claimed that youtube indexed copyrighted videos differently and therefore wanted access to the source code. Good thing the judge saw past this. But it makes me question if viacom truly cares about fighting piracy or they just want people's viewing habits and came up with a less than clever way of doing it. To be honest, im not quite sure how much 'piracy' youtube facilitates. I think google does a pretty good job enforcing and taking down copyright stuff, and it bothers me that viacom thinks they are not doing enough. Youtube's business is to host videos of whatever the public uploads, not to enforce this content. Why should Viacom go after youtube of all things if they want to 'fight piracy?' Oh right, because they can make money because they know google has the cash. Whoever mentioned the thing about childporn, how is that relevant at all? There are all sorts of 'youtube porn sites' that have no relation to google whatsoever. Viacom should go after them. |

I can see Viacom asking for relevant data pertaining to their copyrights, but for ALL viewers habits? I mean ALL of it? Why all?
I don't care for Google (my personal opinion) but I do hope they either A) never give up the data, or B) if they really have too after fighting tooth and nail, give 'meaningless' data. After all, how would Viacom know what the real data was?

They post Copyrighted material on YouTube and then push ads in a lot of the videos or on the sides of the pages. You don't say they don't make any money off it? |

The Problem I have with most official video sources is as follows:
- Sometimes the player will not rewind or fast forward right if you stop a show and want to pick up where you left off later. I'm looking at you, CBS Price is Right Player.
- In early beta players, video is sometimes slow loading...
- The same 20 second add five times in a show is a tad annoying...either cut the add, or show different short ones..
If youtube can upgrade the quality, the companies can use this service to their advantage as well..putting shows on there to gauge the audience for potential DVD sales, for instance. Seeing how many hits an old show gets for a potential revival.
If only the old fogies at studios wouldn't be so scared of technology and see the great potentials it has.. |

If Google doesn't feel the need to moderate their own site of copyright infringement then they should pay the piper. The Digital Millennium Copyright Act, pushed by the copyright interests themselves, says they don't have to. |
