Readers should note the cover sheet (.pdf) of the court filing lists Richard Gabriel as the RIAA's lead counsel. Gabriel was named a Colorado judge in May and no longer works on behalf of the RIAA.
Yes, I'm sure a company that has sued 30,000 people, including dead people, and can't even get this filing correct is a fine upstanding organization that is being unfairly targeted by Mr. Beckerman. |

The entire civil legal system in the USA needs reform to prevent this sort of abuse. We can start by mandating that winning civil lawsuits requires the same burden of proof that is required for a conviction in a criminal case. That is, a defendant is presumed "not liable" until he or she is proved liable by way of evidence that meets the "beyond a reasonable doubt" legal definition. -- "At the moment of conception." |

Beckerman appears a very effective lawyer who takes his role in the Judicial system very seriously. For the RIAA to "take him on" in thew same Judicial system could well backfire if Judges feel this action is not only unwarranted but is systemic of the RIA bullying quasi-legal approach. |
