ES5 Advertised on TV

Just today i seen an ad on G4TechTV recommending ES5, stating what ES5 makers also claim, a "safe" to use p2p application. they also stated that "they don't support or endorse illegal file sharing, but this is simply a good P2P program."
This just raises more questions in my mind... how does a legit television station promote this software ? and yet a better question WHY??? Did someone just hear of ES5 at the network and think.. "heres a good tech bit segment" without researching into the alleged problems? did the RIAA pay them off to do this? (if es5 is a RIAA trojan of some sort). does the network not believe any of the negative hype brought on by ES5? will they retract this recommendation when they find out that they have potentially put thousands more less experienced users at risk? or perhaps it is to help the RIAA spread ES5??? what are the real answers?
