On the other hand, their response to date is inadequate.
Their public representative here has no information to add.
What are we to conclude?
Are they really giving a pass to ALL WhenU installers, from all sources, and from all vintages (e.g., 6 month old, 1 year old)?

I understand that any comments made here and elsewhere are directed at the decision made by Lavasoft Research. The analysis and decision was their's to make, not mine, nor Fryertuck's.
All I am doing is merely attempting to keep whatever lines of communication open that I can assist with. Like so many others here, I enjoy helping others. I am not trained in HJT, but because of the encouragement of the "Phantom Phixer" and under the guidance of Canuk and others, I was able to learn about Ad-Aware. IAMSKINZ put together an amazing team of individuals who have become personal friends, supporting one another in more than being volunteer helpers on the forum.

a) this is somewhat a tempest in a teapot
b) this behavior is NOT unusual for Ad-Aware, but merely became highlighted due to Eric's great ongoing work
c) the phenomenon may stem in part from Lavasoft's flawed attempt to quantify (with their TAC scale) the real "I know it when I see it" nature of spyware. I'm guessing that if economic or political pressure were to blame, they wouldn't have issued their "I am not now nor have I ever been" disclaimer. Methinks the TAC scale needs to be deprecated in favor of human judgment, and it also needs a historical "memory", as I and others have mentioned here.
d) let buyers and users be aware of whom they're dealing with. Lavasoft isn't the friendliest of companies, but does not seem to have gone rogue at this point.
