Nothing other than funds prevents anyone from building their own network. When I lived in State College, PA, a second cable company, now known as Conestoga, built their own cable TV/broadband/phone network on top of what was then AT&T Broadband and Verizon incumbent service. There's no FCC rule stating that there can be only one such provider for a given area, and if local governments are not allowing competitors to run their own service, then they should be sanctioned for breaking the law.
