With capping the crap out of their users. They've already established a fairly harsh TOS/AUP...they need only start the mailing of nastygrams if 38mbps doesn't cut the mustard. Works for Comcrap.

Qumahlin claims they have since the upgrades. I guess it depends on what you consider lately. To me an old practice would be something done 2 years ago, not 4 months.
