Legal warfare meant to delay fiber project

All this is is Qwest using its large in-house legal staff to harass Utopia. They can both slow down deployment and cause Utopia to run up large legal defense costs - all as part of a strategy to either cause them to go bankrupt or have to increase costs to customers. In either case, Qwest gets what it wants no matter what the courts do. An example of how big businesses win when their product isn't better than a smaller competitor.

Old_Repub the strategy and tactics Qwest is employing would it not have the risk of giving Qwest negative PR? considering the increasing customer service nightmares encountered practically everywhere due to large corporations, which are almost daily being looked upon more and more as the causes of...Where does one start to debate such a dilemma faced by corps.?

Their top flight staff of trial lawyers can't fight bad PR.Utopia would have every right to go public with the red tape and legal defense costs incurred by Qwest to either bankrupt Utopia or the effort to drive up consumer costs.

Does Qwest,after adding up the X's and O's believe negative PR will help add to their total of X and O to pad the bottom line.? Any ISP that drove up my costs with a different ISP,I sure as hell would not reward Qwest in this case any business nor my money.

Unfortunately, you are an exception. Most customers won't care or will never even know the battle is going on. And Qwest, thru long experience realizes the apathy of most people will let them get away with tactics like this.

Correct as usual King Friday.
Utopia, as any entity under siege from a large corporation should, needs to undertake a public information/full disclosure campaign. Running an "Informational" ad in local papers and perhaps television as a means of educating the public as to how their tax dollars are being spent in the mandatory legal rebuttal of Qwest's onslaught. I would suggest a portrayal of Qwest as a giant cranky toddler pitching a temper tantrum because he wants a toy that's not his.

I might agree with your conclusion if not for the fact that its starting to go live. I think these tactics (like BS in LA) were designed to kill it before it got off the ground. They did not succeed here. This is obviously "of the ground". Once the so called genie is out of the bottle, I would think it far better that they play nice and be seen as a team player

Old_Repub.? Why do you find it to be unfortunate on my part?It's not a trick question I don't intend it to be a flame or offend you., I can recall my hometown of Pa. oh lets say..A 1994 deal between the state of Pennsylvania and Verizon.?Perhaps if I may better Illustrate further.
In 1994 Verizon (then Bell Atlantic) struck a landmark deal with the state of Pennsylvania. The deal provided Verizon with hefty financial incentives if they met certain broadband rollout criteria. It's estimated that those financial incentives over the years clock in somewhere around $2.1 billion dollars.

As part of that agreement, Bell Atlantic agreed to have 20% of the state broadband wired by 1998, and 50% by 2004. By 2015, broadband would be run throughout the state to the majority of Verizon's customers. It's important to note that this wasn't DSL they were talking about...but 45MB/s symmetrical fiber service right to the door of homes and businesses,

Out of the 2.1 billion dollars received in the deal, $1.5 billion of it consisted of extra tax deductions.

The state essentially allowed Verizon to completely ignore the agreement, keep all financial incentives, and provide state-wide connectivity via copper lines, ignoring the language of the original agreement.

Commissioner Glen Thomas, speaking in fluent lobby-eese, defended his ruling: "As Pennsylvania considers its telecommunications policy of the future, I believe that our collective energies will be best spent on creating a climate that allows factors such as competition and demand to flourish." Application of such 'energies' apparently doesn't include holding companies accountable for billions in profits already pocketed for services that were never deployed.Is that what you refer to.?

Not unfortunate on YOUR part. That may have been poorly worded. I meant to say that it is unfortunate that more people aren't like you. Most will be totally apathetic and companies like Qwest get away with murder because most customers are either ignorant or don't care.
