Unfortunately my drive spins up but thats about it. after a few mails to spinrite tech support their conclusion was its a lost cause and suggested some data recovery companies. not worth the price just for mp3s. guess ill just chuck the drive.

Yes, if the BIOS can't see the drive, there's not much chance of any software seeing it, no matter how low-level the software is.

Well how do these data recovery companies do it then. i assume it involves a cleanroom and removing the platters etc. . .
