I know this is not about this case, but I was just wondering. If you are offering pay for wireless in your business can you sue anyone broadcasting a free internet ap onto your property, which in turn is losing you money??

sure.. you COULD.. if you paid big bux to license a frequency band from the FCC. Then only somebody with a license (thats you) could legally operate in that band. With all forms of WiFi, this is not the case, since Wifi are located in non-licensed "public" frequencies. The 2.4ghz band is a congested place, full of 2.4ghz cordless phones, bluetooth, and microwave ovens.

Also, the concept that somebody is "broadcasting" free internet into your airspace (property), isn't quite as you see it. They are not "broadcasting" internet into your airspace. Yes, there is a signal being transmitted into your airspace, but unless your radio (wireless network card) transmits back into the above property(Free internet ap), there will be no internet connection/use. It's a two-way street.

Of course starbuck$ would like to sue Mom & Pop Joe for providing free internet next door to starbucks, but it's a futile lawsuit.
