I have a hard time see that it is a crime.
what did he do.

1) Listen to some Legal radio band.
2) Transmit on the Legal band.

No cracking of codes or passwords. This is what it really is listen and transmit on legal radio bands.

It is like use a CB radio or the walkie talkies.
