This won't work!

The idea is stupid.

ISP's already state that they offer up to x mbps. Not we guarantee x mbps.

For example, my DSL is sync'd at 3000/512. Well, if I happen to get 1500/384 one day, I can't do anything about it because my plan is up to 3mbit.

Not to mention Joe User will stumble upon a website with a crappy server, only get 10k/s and try to get a refund from his ISP for that.

AMEN! This guy knows what's going on.Plus the speed tests have to come from a server that is on your ISP's network.ISP's can't control the speeds, bandwidth etc. outside of their gateway.That's like being on the east coast and testing your speed from a speedtest site in California

Exactly...Many,Many things can cause congestion. That is the way things work. Internet is not gauranteed. Don't like that? Not an answer? Stop using the Interweb. go back to AOL.

According to everyone who is saying you are getting what you pay for because of the "up to" clause of the TOS, then ISP's can state any speed they want even when they know it isn't possible to deliver them. For example Comcast could say get speeds up to 100Mb when they know they can only deliver 8Mb and that is perfectly fine by your reasoning.
