Actually what I got straight from the horses mouth, so to speak, was that downloading a song you previously purchased falls under fair use. Even if you bought a vinyl copy and downloaded an mp3 that came from a CD. This specific question was raised a couple years ago and answered by a representative of the RIAA in an interview. He also said they do not mind people lending out CDs. Now how much of this will change as they want more control is another story.
