AFAIK It isn't PCMM that comcast is using

They are using some proprietary software added to each CMTS from what I have read.
Where I read that says that everyone thinks what it is is PCMM, but it isn't.

Comcast has a patent pending on powerboost.
Now I'm no lawyer, but I don't think you can patent a specification.

If I can find the article I read about this again, I'll post the link.

Oh BTW Karl, "months later" there are a bunch of us still waiting to see powerboost in the first place.

I am and yes you can.

Seriously though, there are many ways of doing this. The simplest would be through a method patent. I do it all the time . . .

Ok, I wasn't very clear about what I meant, let me rephrase this...Can you patent a spec that you didn't come up with?

It would make sense to do your own, but how can comcast patent what cable labs came up with?

Cablelabs is kinda huge, you would think they would patent their own stuff before letting someone else no?

Either way I forgot to even look for the article, but am quite sure this isn't the technology that comcast is using.

Depending on the business agreement the parties have, there can be a couple of different ways in which Comcast is pursuing a patent. First, Comcast may have had a hand in conceiving or developing the concept. In that case, a Comcast inventor would be named in the patent. The parties would then decide in a separate agreement as to ownership issues.

Second, if Comcast hired and paid for Cablelabs to develop this product, then Comcast could have Cablelabs assign the patent over to Comcast.

Both of the above scenarios are very common. But, we'd have to see the patent application and inventors names/employers to really make a more specific guess.

And, like you said, CC may not even be using the CL technology.

Karl was informed, by a comcast employee that they don't use pcmm and has adjusted the article to reflect.

I couldn't find a Comcast patent or application regarding this technology. So, it must be relatively new.

I did find it interesting, though, that Comcast has few issued patents (6 or so), but a significantly higher number in the works. Seems that they must be getting more aggressive in protecting their IP.
