Unless somebody can ID her sitting at the computer and actively browsing porn (and not some fly-by popup either), her defense could very well be legit. If all the prosecution could bring up is that they found porn in the cache, she could very well be telling the truth. | |

In it, he takes a freshly installed copy of Windows XP and browses to one site. Then, with no prompting whatsoever, spyware starts getting installed until his computer is at a stand-still. So browsing to one seemingly innocent website and winding up with porn pop-up spyware is completely possible. (SP2 closes the holes that his video used, but it's also likely that the school didn't install SP2.) His video is 2 years old, but still applicable.
Not only that, but apparently, they didn't even search the computer for spyware! They just went ahead and blamed the teacher. It happened to a British man, and IIRC, his case was eventually thrown out because what happened was through no fault of his own.

Regardless of the outcome her life is ruined.

If the computer contents weren't cracked open to discover ad/spyware to attest to her defense, I'd call that some gross negligence on the court's behalf (assuming this trial is a criminal one - anything can go at a civil trial). Anyone who's even worked with computers in the least could confirm that her defense was at least believable. It sure seems like the snow job from the school district has worked.
