Rogers cutoff inet for game torrent dload!

I have been cutoff from internet access with Rogers HiSpeed internet service recently, apparently for downloading a copy of sid meiers' civilization 4 expansion called warlords. before the suspension of the service, i received a phone call and an email about the reason for the suspension. in the email, they've stated the filename, the port it was downloaded on, when, and using which software. they claim they will be providing the owner of the copyrighted software with the info, opening me up to prosecution.
I'm in Toronto Canada. Is this legal? I dont see how it could or should be. im not selling or reproducing this software, in fact i havent even tried it yet. besides, i dont see how aquiring something that someone has provided to the world via the world wide web for free as illegal on my part. my reasoning behind this is, for example i create a copywrightable work of art, then publish it online, i am therefore surrendering the piece to anyone willing to view it. once their eyes set sights on it, can i then sue anyone who may have viewed it? computers after all must make a copy of the image onto the local hard drive before anyone views it.

please provide advice if any

Not like you stated it, no.

You have the right to contact Rogers legal and tell them not to give your info to anyone while you seek legal council. They just can't give it away just like that just because they called you and said they would. You can sue them for that.

Paying for something and not getting it could also be considered theft...(e.g. paying for a service only to have it throttled).

For everyone defending Canada in this... not everything has to be an us vs. them you know. This has to do with Rogers being an awful provider of... umm... everything. They have us by the balls if we want high speed internet and those of us in their area can do nothing. For example, in my area I have 3 choices: Rogers high speed at 6megs, Bell DSL at only 512k (because the lines in my area are old) which is unacceptable and dial up which is even more unacceptable. This means Rogers can do whatever the hell they want and if I want to keep a connection with decent speeds, there is NOTHING i can do about it.
The moment there is an alternative or I move somewhere where better DSL is available, I am off Rogers FOREVER. So yes, their heavy handed tactics may work for them now, but in the end, they will lose business when the day comes that we have more choices.

Rogers is being unfairly attacked here -- with phrases like "Rogers is a scam". Rogers is very clear on what it is selling. I monitor my speed (I live in downtown Toronto) at least a half dozen times a week, mornings and evenings, and have been doing so for a couple of years. While there have been occasional drops, I consistently get the rated speed.

The note above confirms that, locally, Rogers is much better than the competition. Rogers has clearly defined (and generous) caps in place and very, very few people have actually been cut-off (they have 1.2 million Internet customers).

As has been noted, instead of stopping BT -- which is causing headaches for all the other users on the network -- they found a compromise solution of "capacity shaping" throttling. Residential users are specifically NOT allowed to run "servers" in their contracts yet even here Rogers let's you do anything you want up to the point it hogs the network taking away QoS from your neighbours.

I'm sorry, but this 'solution' is very heavy handed. If they shaped the traffic to something acceptable and usuable by BT that would be one thing. However, most people are getting speeds of 1-5kup and maybe 10-20k down. You can say we're being "unfair to Rogers" all you want, but if I am paying 60 bucks a month for a connection that lets me download at roughly 700k and upload at just under 100 and Rogers decides that I can only use literally a FRACTION of that for my application of choice then I can say that I feel ripped off. They could set aside half our bandwidth or hell, even a QUARTER and I wouldn't bitch and moan... however throttling to 1/35th of my download speed just isn't fair business.

Legally they aren't allowed to release any of your information unless it's requested with a court order.
