It's not the same as the good ole' innocent until proven guilty sort of due process in a criminal court. While it's not completely backwards I do believe in some cases you do have to make some effort in proving innocence. |

If in this case RIAA only has your ip then you can argue that someone else hacked your wireless and used that to download. How can RIAA show that it's more likely then not did that did not happen. Reason why so many settlements have been happening is because it cost around 4-5k a day for a trial(that includes lawyers fees, court fees etc.) For a lot of people it's just to expensive. Any person with money that challenges RIAA wins as RIAA usually will just back down instead of fighting a fight they know they have high chances of losing.
