what made the upstream finally perform as advertised?

I thought cable internet speed caps were configured at the modem as part of the modem's configuration file downloaded via TFTP during initialization. Assuming this is the case, why is it that when users were upgraded from 10/1 to 15/2 the increase was instantly where it should've been, when users got 30/2, the speeds were also around where they should've been. Yet when the upstream on boost was boosted to 5mbit, users only got around 3.5-3.8mbit upload. This even though their modems were configured for 5mbit upload. Now suddenly users are getting the configured 5mbit speeds, even though nothing changed at their modem. Any idea where the change could've been made? It'd be interesting to see what cable modems on other providers would do if they were set for 5mbit upload. I'm pretty sure most modern cable modems can do 5mbps upload?
