| They are legally OK, even if they are not doing the right thing. I don't think the amount of bandwidth needs to be regulated... BUT as the industries consolidate, there needs to be government oversight to ensure there is no collusion going on between broadband companies.
Right now Comcast and Verizon/ATT are competing for real, so published caps are not going to happen. But once they start colluding, they'll pick a number and stick with it, no matter how far technology advances. Government doesn't need to regulate, they need to be there to stop any anti-competitive behaviour when it happens.
The best way to compete is how Verizon (and ATT to a lesser extent) is doing it, make a better network than the other guy and let the weight of consumer demand squeeze their competitors who can't keep up. |

Any ISP has the right to maintain their network as they see fit, but that's not the point of the article or most of the complains.
The point is Comcast is NOT being honest with their "CAP"
Let me give a perspective: I'm driving on a highway on a sunny afternoon I'm thinking..hmm...weird...no speed limit posted after driving for a while I keep on driving and driving.... Suddenly, a cop pulls me over Both of us pull over, I roll down window,
Me: Good afternoon, can I help you officer? Cop: Good afternoon sir. Do you know you were driving too fast?
Me: Ummm, no Cop: Yes, you were speeding.
Me: Ummm, what's the speed limit? Cop: I'm sorry sir, but I can't tell you that
Me: ....... |

The point on that example is that the cop is being dishonest. Like u said "There's still a speed limit". Then, the cop should tell the speed limit.

Even though they was no speed limit you could still receive a ticket if an officer felt you were going faster than what was considered within reason.
Of course now they have a speed limit, but many places that don't have specific rules about things judge on a case-by-case basis. |
