 | LOL...By hitting the record button on your remote, you aren't directing CV to record what you want so it can be played back later. They've already recorded it and it's in their hands! Read....They have 1 copy for each show recorded on their property. Now, all you have to do is tune into their "on-demand" channel to retrieve NOT the stream from the sender, but from CV. This is the grandest re-distribution of copyrighted material almost ever schemed! |

If so, then you are right - it would have been a blatant re-distribution of material. However, I would have thought it much more likely that as far as the user was concerned it was no different to a normal DVR, just with the recording at the head-end. Of course, Cablevision would only need one copy of each program that had been recorded, deleting it when the final user deleted it, thereby saving disc space, but this would be transparent to the user. |

I think the key difference between something DVR-like and something VOD-like is whether a program is only available to someone who has consciously made the effort to record it, or if it is available to everyone. |

Overturn the WHAT? Betamax was a Sony product, they didn't sue themselves to stop distribution of their own product! (I think you mean the Sony Betamax ruling)

| reply to DMS1 NEW RULE: No one over 40 should be hearing a legal case which is in any way related to modern technology.
I bet that the judge has no idea what a DVR is and he probably made some stupid hack joke like "My VCR is still blinking 12:00."
The senate committee overseeing the XM-Sirius merger couldn't properly pronounce Sirius. Very troubling.
I applaud Cablevision for battling the industry and not backing down when they initially threatened to sue. Rather than taking the wait and see approach, they became proactive.
By the way, my DVR is physically located at Cablevision's headquarters on Long Island. That's right. I have a special coaxial line that runs all the way from Bethpage to my house in the Bronx.

 | ...and that difference is precisely what violates the fair use act, doesn't it? You can't distribute content that isn't explicitly intended for that use from one site to another, unless both media at each location is owned and operated by the end user. |
