I don't know if this has been posted here,if so please excuse the duplicate.
As a prize-winning freelance photographer who has shot numerous accidents and fires for the local fire department, Elmer Cavender likes to work close to the action.
On Jan. 19, when Cavender's portable radio scanner alerted him to a major accident just east of town, he quickly rolled to the scene in his old gray Buick.
But this one would soon prove different from the hundreds of other wrecks and fires that Cavender has covered over the past decade.
It would lead to the loss of his film and negatives and a felony charge, making him the reluctant subject of a First Amendment debate. -- Gallery |

It looks to me that everyone is just upset because of who was involved. It is emotional and that is why it is being made into such an issue.
I would tend to agree the case against him is flawed.

They can't....that would be admitting someone was wrong and open the door for lawsuits. Not sure how I feel about selling the pics and showing them around to others. We're already there...Constitutional Rights are bypassed and stepped on every day. I don't always agree with the battles that the ACLU wages but where are they in these cases?

Well and you think of all the photos out there in the public space by journalists etc. He's being singled out for something which IMHO isn't illegal because they just don't want those specific photos shared.
I ask how this is any different than any other photog who takes accident or other news images.
In terms of selling them, well I dunno either but we certainly see enough cases where images like those are sold/shared with no ill effects. So why go after him this time?
