Civil punishment won't solve the problem

If they win a civil judgement against him, he will always have money to cover it or use lawyers to appeal and draw it out as long as possible.

There are 3 solutions:

1) Pile up so many lawsuits that he can not financially defend himself and he goes into bankruptcy. Not perfect, but the odds are he'll receive a criminal punishment somewhere along the way with time behind bars.

2) Pass laws that put companies out of business that pay entities that promote rogue marketing tactics. When the money dries up, it is pointless for these scum to continue.

3) Criminally punish all spammers. Sentence to 1 day in a Federal "pound me in the a$$" prison for every destination email address on their mailing lists. I am sure there are companies like AOL and Yahoo who could easily present logs showing how many of their accounts were hit by his garbage. Even with good behavior (unlikely when your cellmate is your girlfriend) they would never see the light of day again.
