eminent domain = missing boxes

"limited eminent domain power to build a box on private property,"

I want next gen broadband as much as anyone but if tried using eminent domain to install one on my property, they are going to find it missing or locked behind a 10 foot fence with a mean as hell rottwieler.

I'm pretty sure that would be considered trespassing + it will be interesting to see what they say in court when they are sued for destroying a fence on my property.

I'm also sure the more persistent types will find other creative ways to make it difficult... after the 10th time, I'm sure it would be in the companies best interest to relocate that box to more appropriate place.

If a utility has a RoW you can not bar them from accessing it. They have a legal right to be there and you can not get them charged with trespassing.

If you make it difficult for the telephone guys who have to work on it, they could make it very difficult for you too. They don't have to make the site look pretty. You wouldn't appreciate ruts in your yard, trash, or other things piling up near the box. So be a friendly neighbor and the technicians will be friendly in return.

If they want to be friendly, don't install huge ugly grey boxes on peoples property without their consent!

I can't be the only one who feels that a company shouldnt be able to just up and claim a portion of your property because they say so.

They're not. There's a right of way. The homeowner either sold it to them or bought land that already had it carved out.
