NetFixer and N-P both have gotten a thorough airing of what they have to say. That's exactly how message boards are supposed to work. Wandering off into talking about mental illness and whether we'd personally press charges for a latenight phone call is, well, wandering off...

Sorry, you must have misunderstood there is no lawsuit either nor in FL or TN or anywhere.Netfixer apologized I accepted his apology. Why don't you read this article for better use of time:

HONG KONG (Reuters) - Scientists in China have identified a gene variant which appears to protect Chinese people from various types of cancer.

In the latest issue of the journal Nature Genetics, the experts said they had studied the DNA of nearly 10,000 Chinese people over 6- years and had found that the gene variant appeared far more frequently in those who were cancer-free.

"We have identified a variant of the CASP8 gene that appears to be associated with lower risk of lung, oesophageal, gastric, colorectal, cervical and breast cancers in Chinese people," Dongxin Lin of the Chinese Academy of Medical Sciences in Beijing wrote in an e-mail to Reuters.

It is well known that the gene caspase-8 (CASP8) regulates cell death. Programmed cell death, or apoptosis, is important because it prevents cells from dividing and spreading uncontrollably, a process that can result in cancer.

However, scientists know little about the variants of this gene and the roles they play in cancer susceptibility.

Between January 1997 and July 2003, researchers in various cancer institutes in Beijing examined the DNA of 5,000 patients with lung, oesophageal, colorectal, cervical, stomach and breast cancer, and 4,972 others who were cancer-free.

The gene variant showed up in 25 percent of those who were cancer-free, and in 20 percent of those who had cancer.

Explaining how this gene variant might have benefited its carriers, Lin said: "Carriers may have lower apoptotic cell death of T lymphocytes (white blood cells) when they fight with malignant or premalignant cells."

"The immune status is very important in cancer development, and genetic variation in the immune system is associated with predisposition to cancer," Lin said.

The discovery may help identify high-risk individuals.

"The genetic variant we identified might (serve) as a genetic marker in identifying high-risk individuals, which is an important step in targeted prevention and early detection of human cancer," Lin said.

Cancer is a leading cause of death worldwide. It accounted for 7.6 million, or 13 percent, of a total of 58 million deaths worldwide in 2005, according to the World Health Organization.

WHO projects that figure rising to 9 million in 2015 and 11.4 million in 2030.

Dear Mr. N_P

By Florida law you simply have no case against the person simply known as netfixer. As Netfixer said already he could not delete his post as it was already in the archives. He advised you to contact the admins, something to my understanding has already been done by your self. From reading all the threads it looks like the admins have not yet decided to remove the post yet. They may still remove the post but have yet to make a decission. Why threaten netfixer, he cant make it disapper any faster. You claim all he has to do is contact the admins, well as someone who has had something removed from the archives ( a deletion of a post written by my self it took almost 10 days for it to be removed) Removing post from the archives is not something they do lightly or something that happens in mere minutes around here. Also I have to say that I am ashamed to live in the same state as you. The company that you are associated with got alot of bad press 2 to 3 years ago, at the same time that same company was not doing anything to improve there image. I remember the updated.com problems. I know someone personally who was caught up in the mess back then and he still has nothing nice to say about updated.com. So you can stop with your empty threats where you have no legal grounds. Please go see a shrink as your actions here make me want to belive that you need professional mental help.

As far as I am concerned, if someone purposely makes an unwelcome phone call to my residence at 3 AM, it's going to pursued as harassment.

I'm sure that N_P and NetFixer will come to an understanding if the rest of you put down 1, 2 and 3 and let them 4) communicate.
Don't you mean N_P and Netflix?

Hogwash. Not only do we have too many lawyers, we have too many armchair lawyers.

"If someone simply disagrees with you, however strongly or unpleasantly, that isn't harassment. Someone who sends you a single email message that isn't overtly threatening probably hasn't harassed you. ... Harassment usually involves repeated communications via email or some sort of instant messaging program after the harasser has clearly been told to go away." (emphasis added)

You'd think from reading this posting that the only ways to resolve problems are:

1) Insults
2) Lawsuits
3) Weapons

I'm sure that N_P and NetFixer will come to an understanding if the rest of you put down 1, 2 and 3 and let them 4) communicate.

This "cowboy" mentality is what usually turns a "misunderstanding" into a "situation".

This guy's a doofus who can't tell the difference between Netflix and NetFixer See Profile, and who apparently has no shame about making a fool of himself in public.

Well just maybe through it all..you might find another friend .

“Oh, the comfort, the inexpressible comfort of feeling safe with a person, having neither to weigh thoughts nor measure words, but pouring them all out, just as they are, chaff and grain together, certain that a faithful hand will take and sift them, keep what is worth keeping, and with a breath of kindness blow the rest away.”

1) Because Doctor Dan, neither the police nor the phone company will act on one phone call. They have better things to do with their time. Besides, should they put everyone making an unwanted phone call at 3am behind bars (ex-girlfriends, ex-boyfriends, etc.)? You need repeated action and intent. He apologized, and that doesn't sound like harassment, more like a mistake.
There is repeated action and intent: unwanted and harassing email messages and phone calls.

said by Blue2 See Profile :

2) There is no countersuit when then is no lawsuit to begin with. I suspect there won't be one. Furthermore, IF the phone call were a criminal offense, it would NOT be a "countersuit", it would be a criminal matter pursued by the state. If there were a civil suit, what would the damages be? No damages, no lawsuit.
Harassment is grounds for a countersuit (or a lawsuit, if the opposing party hasn't already filed).

said by Blue2 See Profile :

3) Have you ever started a lawsuit? Any idea of the time and expense involved? Anyone who knows will tell you to avoid lawsuits at all costs. They are NOT the solution to problems, and only those who have never been involved in one suggest them.
Yes, I have. My sister also happens to be an attorney. Those who like to throw threats of lawsuits around usually blink when they're reminded that some of their activities (e.g. harassing phone calls in the middle of the night) could be construed as criminal acts, and not looked upon too kindly in civil court.

Thank you for your wide interest and I am glad you found that case so that you can better understand some of this. That case we won on summary judgment. Needless to say a lot of that maybe related here.

It shows you that there are individuals out there that have motives and reasons to want to defame other people. Consider that carefully. Did you know what really happened or why or who wrote what you read before you take upon making a statement or "through your punch" on someone you never met and don't know?

By the way there is no secrecy about me or Updated so instead of searching for "things" ask or I can tell you, Updated.com was owed by GlobalBell until 2002 and then by Updated.com Inc. About me, I am Nicholas I am 35 years old and I live in FL. What happened? I was told by someone I personally care very much about to read the post from Netflix (I didn't know about his post) so I contacted Netflix. I didnt know who he is and so asked him what was his post about or if he knows me. He said he didn't remember it so I sent him the link and information (I never threaten him at all until he started this new thread). And he kept posting what I was hoping I was going to be able to point out to him personally without all this (and with respect to my privacy). I just wanted to point out to Netflix that he relied on source(s) that were bad, without all this.

As you probably know friends and family occasionally look at the internet and search for our names and I think it’s only fair to respect each other. If anyone wants to contact me personally feel free.

Send me a note at nicholas(AT)updated.com

Sincerely

N P

Actually that ended with his 3:17 AM harassing phone call. I guess his lawyer forgot to warn him that such actions could expose him to criminal prosecution.
So, why didn't you report this to the police and the phone company? If some douchebag tried this stunt with me, that's precisely what I would have done, and I would have pressed the issue until criminal charges were filed.

The followup would be a nice fat countersuit. It's pretty hard to demonstrate that you're not "infamous" in civil court after you've been convicted in criminal court of calling people up in the middle of the night and verbally harassing them.

I think Nicholas may have received some bad PR from this. Never heard the name or the site before. Now that I have, it shines with a negative light. 3 year old post and now he wants to threaten legal action THEN offers a job? Dude, you cant blame Google or anyone else for what they say about you. How much time do you spend going after people saying things about you?

sounds flaky as hell to me.
