Re: Nicholas Papadopoulos and updated.com

FYI:

Even if there were libelous statements, which I don't personally see in this case, the statute of limitations would have run out.

State of poster:
Tennessee- 1 year
»www.expertlaw.com/library/limita···see.html

State of complainant:
Florida- 2 years
»www.expertlaw.com/library/limita···ida.html

State of this website:
New York: 1 year
»www.expertlaw.com/library/limita···ork.html

Federal case in Texas:
Libel limit applies to web postings

I respect the fact that he apologized. I hope that the site management proposes a good solution.

Well in return if indeed Royce wants to do better I would in return make a good deed and would offer Royce a job if he can do some work to improve our server network setup. I would rather do that than have to hire an attorney over this matter. Royce are you interested? can we talk business instead of this?

I truly like to see something productive come out of all this and hope Royce agrees too.
I had not intended to respond any further in this thread, but to leave it for you to explain your position in whatever manner you should choose.

However, since you appear to have indirectly asked me a question in your reply to La Luna See Profile, I will respond to that question. The answer is thanks for the job offer, but I don't think such a business relationship would work out.

Royce, thank you for replying anyway.

For the person that asked (why and when? ) I just saw Royce's post yesterday and contacted him right away about it, he knows.

said by NetFixer See Profile :

I suspect that Nicholas Papadopoulos is a real person (or at least a real persona) based on the old whois data (which used to be much harder to mask or spoof), as well as the Caller ID in my Vonage call log.
Nicholas is a real person. Using the whois address that was posted above, 101 20th Street #3401, the property owner comes back as ELENA PAPADOPOULOS.

Feel free to search yourself:

»gisims2.miamidade.gov/myhome/propmap.asp

Next, take that name over to the Miami-Dade County Clerk search page, and plug that name in last name, first name and you find Nicholas.

Search with his name (last name, first name) and you can read some civil court papers regarding another slander/defamation case!

"Why does your website with only one visit and page open to it make my router Nat table look like this..."

I am not the administrator but I will ask. I really don't know but if the administrator can't find out or if you have some time can you help figure this out?

Looks like it could be Cogents network, where are you located, can we get in touch?

Let me know.

Thanks

Which site is being talked about. Before I say anything. Visited one site may or not be it but well just ? Not a bad or good statement just well why. May have visited wrong site.

edit;

Slow me may have figured it out. Is this like an add? Helps you get what you are looking for? If I am right sorry I never use this type of page. Good or bad. Direct links and search engines are my friends.

After reading 4 pages of posts why not just walk away, it's a forum on the internet before this I didn't even know about updated.com but now I do see you got publicity I'm not going to bad mouth "N_P" because he might sue me or seomthing but after reading all this why not let the issue die so what if something was said it's the internet.

People trash each other all the time true or not besides if the post is deleted it's cached on some web crawler or something just give it up go back to your day job and get over it.

besides how can you claim that netfixer ruined your business or put a monetary amount of "damage" that he has caused.

Whatever though just my 2cents please don't sue for the right I have to have freedom of speech.

Hi NP,
Listen. We are sorry what happen to you with SIDI.
And we respect your right for free enterprise no matter what business you conduct. But many of us thought that after you had suffered with lawyers and hardships, you would be the last one to start harassing another individual
like NetFixer. If I were you, I would go to the above link and set the record straight on the outcome. I feel that is more damaging to your real reputation.

Be Well

I second that. NetFixer has acted like a pro here.

I know that if I wanted to hire a consultant, that is the thoughtfulness I'd look for. It took reflection and consideration to respond like this, and what client wouldn't want that.

i'm not ready for this to be over, i still have some popcorn left

I think Nicholas may have received some bad PR from this. Never heard the name or the site before. Now that I have, it shines with a negative light. 3 year old post and now he wants to threaten legal action THEN offers a job? Dude, you cant blame Google or anyone else for what they say about you. How much time do you spend going after people saying things about you?

sounds flaky as hell to me.

Actually that ended with his 3:17 AM harassing phone call. I guess his lawyer forgot to warn him that such actions could expose him to criminal prosecution.
So, why didn't you report this to the police and the phone company? If some douchebag tried this stunt with me, that's precisely what I would have done, and I would have pressed the issue until criminal charges were filed.

The followup would be a nice fat countersuit. It's pretty hard to demonstrate that you're not "infamous" in civil court after you've been convicted in criminal court of calling people up in the middle of the night and verbally harassing them.

1) Because Doctor Dan, neither the police nor the phone company will act on one phone call. They have better things to do with their time. Besides, should they put everyone making an unwanted phone call at 3am behind bars (ex-girlfriends, ex-boyfriends, etc.)? You need repeated action and intent. He apologized, and that doesn't sound like harassment, more like a mistake.

2) There is no countersuit when then is no lawsuit to begin with. I suspect there won't be one. Furthermore, IF the phone call were a criminal offense, it would NOT be a "countersuit", it would be a criminal matter pursued by the state. If there were a civil suit, what would the damages be? No damages, no lawsuit.

3) Have you ever started a lawsuit? Any idea of the time and expense involved? Anyone who knows will tell you to avoid lawsuits at all costs. They are NOT the solution to problems, and only those who have never been involved in one suggest them.

4) If some of you act as impulsively as you talk, heaven help us.

Thank you for your wide interest and I am glad you found that case so that you can better understand some of this. That case we won on summary judgment. Needless to say a lot of that maybe related here.

It shows you that there are individuals out there that have motives and reasons to want to defame other people. Consider that carefully. Did you know what really happened or why or who wrote what you read before you take upon making a statement or "through your punch" on someone you never met and don't know?

By the way there is no secrecy about me or Updated so instead of searching for "things" ask or I can tell you, Updated.com was owed by GlobalBell until 2002 and then by Updated.com Inc. About me, I am Nicholas I am 35 years old and I live in FL. What happened? I was told by someone I personally care very much about to read the post from Netflix (I didn't know about his post) so I contacted Netflix. I didnt know who he is and so asked him what was his post about or if he knows me. He said he didn't remember it so I sent him the link and information (I never threaten him at all until he started this new thread). And he kept posting what I was hoping I was going to be able to point out to him personally without all this (and with respect to my privacy). I just wanted to point out to Netflix that he relied on source(s) that were bad, without all this.

As you probably know friends and family occasionally look at the internet and search for our names and I think it’s only fair to respect each other. If anyone wants to contact me personally feel free.

Send me a note at nicholas(AT)updated.com

Sincerely

N P

Good Luck and best to you and the family.

There is repeated action and intent: unwanted and harassing email messages and phone calls.

Harassment is grounds for a countersuit (or a lawsuit, if the opposing party hasn't already filed).

Yes, I have. My sister also happens to be an attorney. Those who like to throw threats of lawsuits around usually blink when they're reminded that some of their activities (e.g. harassing phone calls in the middle of the night) could be construed as criminal acts, and not looked upon too kindly in civil court.

You didn't read my earlier reply to this. The phone number from Netflix was posted on his website as his business phone (don't waste your time on this).
