Nice red herring

The first amendment doesn't prevent two parties from entering an enforceable contract in which they agree to keep information private.

Ok I'll bite. Show me the enforceable contract.

Ever seen a non-disclosure agreement? That is binding within the limits set out in it.

Ok I'll bite. Show me where he said there was one. He just commented that 1st amendment doesnt prevent such a contract.

Of course I have seen a non-disclosure agreement. I wasn't aware that VZ entered into them with their customers. I don't recall signing anything....

What about privacy policies? You sign up and they give you the details on how your information is handled. Did they disregard that policy in this case?

You wanted an example of a contract where people agree to keep information private, right? You got one.

If it was in the TOS with Verizon then that would be one too - violate that TOS, lose the service. Verizon violates laws about handling customer information, they get prosecuted.

That, BTW, is also a contract.
