No Servers allowed per the TOS

I assume that due to the "No Servers Allowed" TOS Terms, that running a BitTorrent Client (which has a built-in Server function as part of its operation), means that I am in violation of this TOS provision.

Mine Does - CableVision/OOL allows SMTP and Web Browsers if you have a BOOST (30/5) account in lieu of the standard 15/2 account.

So do I (OOL). My query was retorical in that I was asking if the NO Server restriction was/could-be used as an excuse to ban BitTorrent (or other P2P) usage without explicate definition of P2P-Type programs as an non-permitted application (due to the embedded Server).
