I'm no lawyer but I don't think the stockholders even had a say in what happened following the bankruptcy filing. Who gets paid are the lawyers, courts..employees..and CREDITORS, meaning the individuals, banks and/or companies that loaned them money.
Stockholders are the very last in line and only get whatever is left, if anything. And, in this case, I think the debt of the company exceeded what they even sold the company for.
And, so it was or is probably a total wipeout for stockholders.
Perhaps the creditors could have all joined together and decided to keep the company running by converting their interests to new shares of stock or whatever, but it's my understanding that is only more commonly done when there is little proceeds to be had and in order to try to recoup something down the road, they agree to take an equity interest instead. And to give the company a fresh start by eliminating or reducing the debt it has. But there was no incentive here to do that. They'll recover a great deal of the money they were owed and can just now move on. It's far better to invest in a more stable company like Comcast or Time Warner than risk a smaller cable company anymore. Plus, the price was obviously right and these assets commanded a sizeable price to be sold now.
I think in summary, you have to ask yourself, who really was harmed in the long run? Obviously, some employees who were displaced, but a great deal of them were offered other jobs, albeit in different areas. Customers..simply were given a new provider. The Rigas's..went to jail apparently. The Creditors, will or have gotten most of their money. Lawyers..courts..executives..all have done probably very well off of all this.
And stockholders? A worthless piece of paper to hang on the wall, reminding them of how risky the market can be sometimes. |

1 edit | When a company the size of Adelphia(well any company really) files bankruptcy, "they" have no real say it what happens any more, the Court does all the talking, the creditors wanted their money(what they could get anyway) and selling the company was the best way to do this.
There was little to no chance of Adelphia ever coming out of bankruptcy so the Court did what needed done.
Adelphia's problems had little to do with "The burst"(really a big BOOM) or the market itself but fraud on part of the Regases and their head Administration. -- What was I in Highschool ? A Ghost. |

I began working at the Buffalo TAC in the fall of 2001. After repeatedly hearing about this site from many irate callers, I began to visit and liked it so much I decided to join 2002. During this time, I tried to help here and there. When I left Adelphia in 2003, I still hung out here but posted less and less as I was no longer in the loop on the Adelphia happenings and didn't want to give out outdated information.
I learned a great deal by just lurking and reading Hob and Mac's posts. No matter what happens with the Adelphia/TW situation, you two at the very least will always find success based on the vast knowledge you have in your fields.
I now mainly hang out and help in the »OS and Software forums and read allot of topics in the »Home Repair & Improvement forum (just closed on my first house).
I sure will miss this forum and most of it's members (bbscript??)
