"Stealing" wi-fi?

So, let me get this straight. The iPhone automatically switches to wi-fi when it encounters an open wi-fi network, right? Well, in some places that will get you ARRESTED! (Such an attitude by the law-keepers is stupid if you ask me but it has happened)

I guess they should disable it for US customers then. Once it comes out for other countries with no stupid laws like that we can take advantage of it.
