And regardless of DOCSIS 1.0 or 2.0, you're basically only getting 38mbit shared between all users on your portion of the network. Now how "big" is your portion of the network? It really depends. But back when DOCSIS was first deployed it might have been upwards of 150-250 subs!

That speed is shared with everyone that is doing 5,7,8,10mbit down and everyone doing 384, 512, 768, 1mbit up.
