Well PhoenixDSL doesn't know anything about this

Hmmm... I just got off the phone with a Customer Care rep. at PhoenixDSL and asked her about this article and she said that they know nothing about it at Phoenix. She said that she just looked at it on DSLReports and it seems like this article has come from a disgruntled customer and that if you want out of your DSL contract you'll still have to pay PhoenixDSL for an early cancellation.

So... my question is... is this a bogus article or not? If not then why doesn't Phoenix Customer Care people know about this...

Inquiring minds want to know...

Yeah, that's my reaction. I couldn't tell whether this "article" was a bona fide piece of journalism, or just some dissatisfied customer who just wants to share with the world what some rep may have actually said to him in conversation.

If the article is in-fact bogus, it could be very well be libelous and subject the author to a defamation action by the individuals quoted in the "article," provided what was said is also bogus. But, if in-fact the statements are true, he's is covered. Nevertheless, the statements purported are believable and understandable.

If the article is true, then the implication is that Megapath is encouraging residential customers to leave. Perhaps the next step would be to offer bound subscribers the opportunity to terminate their contract without penalty, which I think is where this SHOULD HEAD if in-fact the policies stated with respect to residential service are true.

At the very least, if a residential customer is deprived of residential service at a level commensurate what he bargained for, then statements made in the article are convincing evidence to support a breach by Phoenix/Megapath and give rise for that subscriber to be excused from any further payment under his contract should he choose to leave the service prior to expiration of the contract term.

parts of article not bogus

I'm the customer quoted in the article. My other posts are consistent with this (I mentioned contacting the press as well as Mr. Taxin in previous posts). I initiated contact with an editor at ZDNet, who put me in touch with the author of the article. I did in fact speak on the phone to the author, and he did quote me accurately.

The author claimed that he had been in touch with people at Phoenix/Megapath (and that they were quite willing to talk to the press). I don't have any direct evidence myself about what was said, but some of our discussion (specifically regarding having e-mails confirmed when received by Phoenix) possibly had an effect on Phoenix's policy, so I believe him when he says he talked to them.

I can tell you that the reporter was a former Phoenix subscriber who had some trouble canceling his service.

Also, Phoenix Customer Care DEFINITELY knew that ZDNet had been contacted by me. I received an e-mail from a supervisor named Cheryl at Phoenix Customer Care that quoted the e-mail that I had sent to ZDNet. Whether or not they took it seriously is a different matter.
