Re: SunRocket Sold Mailing Info!!

Sheesh, it's a Vonage mailing. Like we don't get those every week anyway.

Just in case it was news to anyone, "privacy policies" don't actually.... mean anything... there's no repercussion, as far as I know, for violating one. It just means they're scumbags.

Spamming, on the other hand, at least has some tiny baby legal teeth against it...

Just a comment, when I heard that SunRocket sold us out I cancelled the credit card that they had for billing. Seemed like the thing to do????

Mine wasn't an email spam, it was a physical mailbox spam.

All bets are off if a company goes broke. Customer lists are probably considered saleable assets just like furniture.

I was reading the post and just had to go check my mailbox. I got one too! I also belong to the sold to any bidder club also.

Now I only wonder how many others they sold the info to, maybe it was a going out business sale. Hooker needed cash for that long awaited trip.

This is not legal advice, I am a lawyer, but not *your* lawyer. For discussion purposes only.

Customer lists are NOT normally considered a salable asset in a bankruptcy when there is a privacy policy against selling them. (See FTC v. Toysmart.com, LLC, and Toysmart.com, Inc. (District of Massachusetts) (Civil Action No. 00-11341-RGS). Now I haven't looked at all the circumstances, so this might be one of the limited "allowable" sales, but I personally doubt it.

My suggestion to all of you is to do what I did and file a complaint on the FTC website:

I would think the complaints would be against Sherwood Partners not SunRocket. Is this correct?

Good question. Technically it's SR that's violating the agreement, but a) Sherwood is acting on their behalf and b) who in the hell knows who to get ahold of at SR. Obviously there is still *someone* making decisions.

Anyway, I put down Sherwood as the party I was complaining against but mentioned SR as the "product" as well as explaining the Sherwood was acting on SR's behalf.

You know, now that we know that SR is getting money from selling customers to TB, P8 and Vonage, it might be time for someone to reevaluate whether a class action might actually work. (No, I have no experience in the area). I've considered suing them on my own, but $90 in filing fees to attempt to recover $200 is not the best use of my money.

United Airlines sold my contact info when they were in bankruptcy. I know because I had created an unique e-mail address that was only given to United Airlines. Never received any SPAM on that address until bankruptcy hit them.

I cans see it now everyone wants Sr Tb and Sherwood to be sued. Monday 11am they get served that they are getting sued and decides that they can't afford the suit. They also says that they isn't making enough money and decides the hell with it we'll just shut down and file bankruptcy. 1 pm they turn off the power.
Next every one will be here asking how can i save my number.

I have no problems with TB. As they've stated, they are NOT SR. Any suit against SR would have ZERO impact on TB and their service.

Uh, no. They've stated a great many things, and many of those have proven to be lies. So I see no reasonable basis to believe that they are "NOT SR". I view that status as completely undetermined at this point.

Lawmage,
Thanks for posting here. I'd like to ask your opinion on another topic if I may.

Several sunrocket users purchased Linksys adapters which they own. After sunrocket closed, Teleblend modified the password on the adapters.

I'm of the opinion that since Teleblend is not Sunrocket, they didn't have a right to modify the adapters unless they recieved permission from the owners.
I believe it's clearly Computer Tampering. However I'm obviously not a lawyer, so I'm curious what your take will be.

Privacy policies go out the window when the company tanks.

I'm afraid that I don't know enough about that to make any comments on it. My suggestion to you is contact your state consumer protection department or state attorney general's office.
