Illegal/unconstitutional laws are passed all the time, but until they are declared so (usually by SCOTUS), they (can) continue to be enforced-sometimes for decades! That's a big problem with our Govt...there's no penalty (other then throwing them out at election time) for elected officials doing this type of behavior.
